A bill to be entitled 1
An act relating to prohibited sex-reassignment 2
prescriptions and procedures; amending s. 456.52, 3
F.S.; prohibiting a person from knowingly aiding or 4
abetting a health care practitioner to participate in 5
a specified violation; amending s. 766.318, F.S.; 6
authorizing the Attorney General to conduct an 7
investigation and bring a civil action against a 8
health care practitioner or other person under certain 9
circumstances; providing for damages, injunctive 10
relief, and civil penalties; providing that any 11
damages collected shall accrue to the injured minor; 12
providing applicability; providing an effective date. 13

Be It Enacted by the Legislature of the State of Florida: 15
16
Section 1. Paragraph (b) of subsection (5) of section 17
456.52, Florida Statutes, is amended to read: 18
456.52 Sex-reassignment prescriptions and procedures; 19
prohibitions; informed consent.— 20
(5) 21
(b) Any health care practitioner who willfully or actively 22
participates, or any other person who knowingly aids or abets a 23
health care practitioner to participate, in a violation of 24
subsection (1) commits a felony of the third degree, punishable 25

as provided in s. 775.082, s. 775.083, or s. 775.084. 26
Section 2. Subsection (5) is added to section 766.318, 27
Florida Statutes, to read: 28
766.318 Civil liability for provision of sex-reassignment 29
prescriptions or procedures to minors.— 30
(5)(a) The Attorney General may conduct an investigation 31
and bring a civil action in any court of competent jurisdiction 32
against a health care practitioner, as defined in s. 456.001, or 33
against any other person who knowingly aids or abets a health 34
care practitioner, for damages, injunctive relief, and civil 35
penalties of up to $100,000 for each violation of s. 456.52(1), 36
and each violation of s. 1014.04(e) and (f) or s. 1014.06 37
related to providing sex-reassignment prescriptions and 38
procedures to a minor. 39
(b) Any damages collected under this subsection must 40
accrue to the benefit of the injured minor. 41
(c) This subsection does not apply to: 42
1. Treatment with sex-reassignment prescriptions if such 43
treatment is consistent with s. 456.001(9)(a)1. or 2. and was 44
commenced on or before, and is still active on, May 17, 2023. 45
2. Sex-reassignment prescriptions or procedures that were 46
ceased or completed on or before May 17, 2023. 47
Section 3. This act shall take effect July 1, 2026. 48
