Section 1. Subsection (2) of section 627.0621, Florida 26
Statutes, is amended, and subsection (3) is added to that 27
section, to read: 28
627.0621 Transparency in rate regulation.— 29
(2) WEBSITE FOR PUBLIC ACCESS TO RATE FILING INFORMATION.— 30
(a) The office shall establish and maintain a 31
comprehensive resource center on its website which uses concise 32
and plain language to aid consumers in their understanding of 33
insurance. The website must include substantive information on 34
the current and historical dynamics of the market, data 35
concerning the financial condition and market conduct of 36
insurance companies, and insurance options available to 37
consumers. At a minimum, the website must contain the following: 38
1. Reports, using graphic information whenever possible, 39
which outline information about the state of the market and 40
adverse and positive trends affecting it. 41
2. Tools that aid consumers in finding insurers, 42
including, but not limited to, a listing of all companies 43
actively doing business in this state which includes each 44
company's address, website, and all telephone numbers and e-mail 45
addresses to be used by insureds and applicants for coverage. 46
3. Tools that aid consumers in selecting the coverages 47
beneficial to them, including, but not limited to: 48
a. Educational materials that explain the types of 49
coverage in residential property insurance policies; the 50

difference between replacement cost reimbursement and actual 51
cash value reimbursement; a glossary of common terms used in 52
policies; and a comparison of the coverage, terms, conditions, 53
and exclusions contained in different homeowners' and dwelling 54
fire forms. 55
b. Answers to commonly asked questions about residential 56
property insurance coverage. 57
4. Information about mitigation credits and the My Safe 58
Florida Home Program, as well as other credits and discounts 59
insurers may offer beyond wind mitigation. 60
5. Access to annual statements, market conduct 61
information, all major adverse findings by the office for the 62
previous 3 calendar years, and other information related to each 63
insurer. 64
6. Information on the Citizens Property Insurance 65
Corporation take-out process, the clearinghouse program, and the 66
general information as reported by the office. 67
7. Information on the claim process, including, but not 68
limited to: 69
a. Clear, step-by-step guidance on how to file a claim, 70
what to expect during the claim process, and timelines for 71
resolution of a claim. 72
b. The obligations of insurers and insureds related to 73
claims reporting, claims handling, communications regarding 74
claims, claim investigations, claims decisions, and claims 75

payments. 76
c. For each insurer with active policies in this state, 77
the means by which to report a claim, including any telephone 78
numbers, e-mail addresses, or website addresses used for claims 79
reporting. 80
8. Information on consumer protection, including, but not 81
limited to: 82
a. The rights of insureds under Florida law related to 83
coverage; coverage renewals, nonrenewals, and cancellations; and 84
mandated offers of coverage. 85
b. Contact information, including a telephone number, 86
hours of service, and an e-mail address, for the Division of 87
Consumer Services of the department, and information on how to 88
file consumer complaints with the division. 89
9. Information on news and updates relevant to consumers 90
regarding this state's residential property insurance market, 91
including regulatory changes, information on insurers that enter 92
or exit the market, and industry trends. 93
10. Information on disaster preparedness directly related 94
to insurance, prepared by the office or by the Division of 95
Emergency Management. 96
11.(a) With respect to any residential property rate 97
filing, the office shall provide the following information on a 98
publicly accessible Internet website: 99
a.1. The overall rate change requested by the insurer. 100

b.2. The rate change approved by the office along with all 101
of the actuary's assumptions and recommendations forming the 102
basis of the office's decision. 103
c.3. Certification by the office's actuary that, based on 104
the actuary's knowledge, his or her recommendations are 105
consistent with accepted actuarial principles. 106
d. Whether the insurer uses affiliated entities to perform 107
administrative, claims handling, or other functions of the 108
insurer and, if so, the total percentage of direct written 109
premium paid to the affiliated entities by the insurer in the 110
preceding calendar year. 111
(b) For any rate filing, regardless of whether or not the 112
filing is subject to a public hearing, the office shall provide 113
on its website a means for any policyholder who may be affected 114
by a proposed rate change to send an e-mail regarding the 115
proposed rate change. Such e-mail must be accessible to the 116
actuary assigned to review the rate filing. 117
(c) The statewide average requested rate change and final 118
approved statewide average rate change within a filing is not a 119
trade secret as defined in s. 688.002 or s. 812.081(1) and is 120
not subject to the public records exemption for trade secrets 121
provided in s. 119.0715 or s. 624.4213. 122
(d) County rating examples submitted to the office through 123
the rate collection system for the purpose of displaying rates 124
on the office website are not a trade secret as defined in s. 125

688.002 or s. 812.081(1) and are not subject to the public 126
records exemption for trade secrets provided in s. 119.0715 or 127
s. 624.4213. 128
(3) NOTICE OF COMPREHENSIVE RESOURCE CENTER.—Along with 129
each offer of residential property insurance coverage and at 130
each renewal of such coverage, the insurer must provide notice 131
of the comprehensive resource center on the office's website, 132
required under subsection (2), which must include the website 133
address and a quick response code for the website. 134
Section 2. Subsections (5) and (6) of section 627.7011, 135
Florida Statutes, are renumbered as subsections (6) and (7), 136
respectively, and a new subsection (5) is added to that section, 137
to read: 138
627.7011 Homeowners' policies; offer of replacement cost 139
coverage and law and ordinance coverage.— 140
(5) When establishing the coverage amount or adjusting a 141
claim for a dwelling or other structure under a homeowner's 142
insurance policy, an insurer may not include the value of the 143
land on which such dwelling or structure is located. This 144
subsection may not be construed to permit inclusion of the value 145
of land for dwellings or structures located on the shoreline, 146
surrounded in whole or in part by a body of water, or on land 147
formed or altered by erosion or accretion. 148
Section 3. Subsection (1) of section 627.711, Florida 149
Statutes, is amended to read: 150

627.711 Notice of premium discounts for hurricane loss 151
mitigation; uniform mitigation verification inspection form.— 152
(1) Using a form prescribed by the Office of Insurance 153
Regulation, the insurer shall clearly notify the applicant or 154
policyholder of any personal lines residential property 155
insurance policy, at the time of the issuance of the policy and 156
at each renewal, of the availability and the range of each 157
premium discount, credit, other rate differential, or reduction 158
in deductibles, and combinations of discounts, credits, rate 159
differentials, or reductions in deductibles, for properties on 160
which fixtures or construction techniques demonstrated to reduce 161
the amount of loss in a windstorm can be or have been installed 162
or implemented. The prescribed form shall describe generally 163
what actions the policyholders may be able to take to reduce 164
their windstorm premium. The prescribed form and a list of such 165
ranges approved by the office for each insurer licensed in the 166
state and providing such discounts, credits, other rate 167
differentials, or reductions in deductibles for properties 168
described in this subsection shall be available for electronic 169
viewing and download from the Department of Financial Services' 170
or the Office of Insurance Regulation's Internet website. The 171
prescribed form must also notify the applicant or policyholder 172
if the insurer offers an enhanced discount for a roof system 173
that uses a secondary water resistance, and the form must 174
generally list the amount of discount by type of secondary water 175

resistance. The Financial Services Commission may adopt rules to 176
implement this subsection. 177
Section 4. Section 627.7142, Florida Statutes, is amended 178
to read: 179
627.7142 Homeowner Claims Bill of Rights.—An insurer 180
issuing a personal lines residential property insurance policy 181
in this state must provide a Homeowner Claims Bill of Rights to 182
a policyholder within 14 days after receiving an initial 183
communication with respect to a claim. The purpose of the bill 184
of rights is to summarize, in simple, nontechnical terms, 185
existing Florida law regarding the rights of a personal lines 186
residential property insurance policyholder who files a claim of 187
loss. The Homeowner Claims Bill of Rights is specific to the 188
claims process and does not represent all of a policyholder's 189
rights under Florida law regarding the insurance policy. The 190
Homeowner Claims Bill of Rights does not create a civil cause of 191
action by any individual policyholder or class of policyholders 192
against an insurer or insurers. The failure of an insurer to 193
properly deliver the Homeowner Claims Bill of Rights is subject 194
to administrative enforcement by the office but is not 195
admissible as evidence in a civil action against an insurer. The 196
Homeowner Claims Bill of Rights does not enlarge, modify, or 197
contravene statutory requirements, including, but not limited 198
to, ss. 626.854, 626.9541, 627.70131, 627.7015, and 627.7074, 199
and does not prohibit an insurer from exercising its right to 200

repair damaged property in compliance with the terms of an 201
applicable policy or ss. 627.7011(7)(e) and 627.702(7) ss. 202

This Bill of Rights is specific to the claims process 208
and does not represent all of your rights under 209
Florida law regarding your policy. There are also 210
exceptions to the stated timelines when conditions are 211
beyond your insurance company's control. This document 212
does not create a civil cause of action by an 213
individual policyholder, or a class of policyholders, 214
against an insurer or insurers and does not prohibit 215
an insurer from exercising its right to repair damaged 216
property in compliance with the terms of an applicable 217

1. Receive from your insurance company an 221
acknowledgment of your reported claim within 7 days 222
after the time you communicated the claim. 223
2. Upon written request, receive from your insurance 224

complete proof-of-loss statement to your insurance 226

3. Receive from your insurance company a copy of any 231
detailed estimate of the amount of the loss within 7 232
days after the estimate is generated by the insurance 233
company's adjuster. 234
4. Within 60 days, subject to any dual interest noted 235
in the policy, receive full settlement payment for 236
your claim or payment of the undisputed portion of 237
your claim, or your insurance company's denial of your 238
claim. 239
5. Receive payment of interest, as provided in s. 240
627.70131, Florida Statutes, from your insurance 241
company, which begins accruing from the date your 242
claim is filed if your insurance company does not pay 243
full settlement of your initial, reopened, or 244
supplemental claim or the undisputed portion of your 245
claim or does not deny your claim within 60 days after 246
your claim is filed. The interest, if applicable, must 247
be paid when your claim or the undisputed portion of 248
your claim is paid. 249

4. Carefully read any contract that requires you to 279
pay out-of-pocket expenses or a fee that is based on a 280
percentage of the insurance proceeds that you will 281
receive for repairing or replacing your property. 282
5. Confirm that the contractor you choose is licensed 283
to do business in Florida. You can verify a 284
contractor's license and check to see if there are any 285
complaints against him or her by calling the Florida 286
Department of Business and Professional Regulation. 287
You should also ask the contractor for references from 288
previous work. 289
6. Require all contractors to provide proof of 290
insurance before beginning repairs. 291
7. Take precautions if the damage requires you to leave 292
your home, including securing your property; and turning off 293
your gas, water, and electricity;, and contacting your insurance 294
company; and providing provide a phone number where you can be 295
reached. 296
Section 5. This act shall take effect July 1, 2026. 297
