amending s. 561.20, F.S.; authorizing the Division of 3
Alcoholic Beverages and Tobacco to issue a special 4
license for the retail sale of THC-infused beverages; 5
requiring such license for the retail sale of THC-6
infused beverages; prohibiting the sale of such 7
beverages if such license is not issued; providing 8
penalties; defining the term "THC-infused beverage"; 9
providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12

Section 1. Subsection (14) is added to section 561.20, 14
Florida Statutes, to read: 15
561.20 Limitation upon number of licenses issued.— 16
(14)(a) In addition to any license that may be issued 17
under this chapter, the division may issue a special license for 18
the retail sale of a THC-infused beverage pursuant to s. 19
561.20(a)4., which authorizes the sale of intoxicating beverages 20
by the drink for consumption on the licensed premises of a 21
restaurant. 22
(b) Notwithstanding any provisions in this chapter, or any 23
other law to the contrary, a THC-infused beverage may be sold at 24
retail only by an individual or entity that is issued a quota 25

license pursuant to subsection (1) or a special license pursuant 26
to this subsection by the division. 27
(c) Any individual or entity that has not been issued a 28
quota license under subsection (1) or a special license under 29
this section by the division may not sell, offer for sale, 30
possess for sale, or distribute for sale THC-infused beverages 31
in this state. 32
(d) A violation of this section constitutes an unlicensed 33
activity under the Beverage Law and shall be punished in the 34
same manner as the unlicensed sale or service of alcoholic 35
beverages, including penalties under chapters 561, 562, and 565. 36
(e) As used in this subsection, the term "THC-infused 37
beverage" means any beverage intended for human consumption that 38
contains hemp-derived delta-9-tetrahydrocannabinol or any other 39
intoxicating cannabinoid in any amount, regardless of whether 40
such beverage is an alcoholic beverage. 41
Section 2. This act shall take effect July 1, 2026. 42
