department to the tax collector; providing that such 8
an interagency agreement may include, but need not be 9
limited to, certain grants of authority; providing an 10

Be It Enacted by the Legislature of the State of Florida: 13

Section 1. Section 488.09, Florida Statutes, is created to 15
read: 16
488.09 Interagency agreements with tax collectors.—The 17
Department of Highway Safety and Motor Vehicles may enter into 18
interagency agreements with tax collectors authorizing such tax 19
collectors to enforce this chapter. An interagency agreement 20
entered into under this section is a delegation of the authority 21
of the department to the tax collector. Such an interagency 22
agreement may include, but need not be limited to, grants of 23
authority to the tax collector, or his or her agent, to do any 24
of the following: 25

(1) Prohibit licensees operating commercial driving 26
schools, and their agents, from entering upon the tax 27
collector's premises, including its parking areas, unless such 28
licensees and agents are seeking tax collector services in their 29
personal capacities. 30
(2) Prohibit any course of conduct by licensees operating 31
commercial driving schools, and their agents, which operates or 32
would operate as a fraud or deceit upon a person, the 33
department, or the tax collector. 34
(3) Prohibit any transaction, practice, or course of 35
business related to a commercial driving school which undermines 36
the integrity of the driver license issuance process. 37
(4) Require persons licensed to operate commercial driving 38
schools, and their agents, to present pertinent licenses, agent 39
identification cards, and certificates issued under this chapter 40
upon demand of a law enforcement officer, a department employee, 41
or an employee of the tax collector. 42
(5) Enter the premises where a commercial driving school 43
is located to ensure compliance with state and local laws 44
regulating the business of commercial driving schools. 45
Section 2. This act shall take effect July 1, 2026. 46
