A bill to be entitled 1
An act relating to the administration of medications 2
by pharmacists; creating s. 465.1894, F.S.; 3
authorizing pharmacists, at the direction of certain 4
licensed physicians, to administer medications under 5
certain circumstances; providing recordkeeping 6
requirements; requiring the Board of Pharmacy to adopt 7
rules; amending s. 395.0197, F.S.; requiring 8
facilities to maintain documentation relating to 9
pharmacist qualifications; providing an effective 10
date. 11

Be It Enacted by the Legislature of the State of Florida: 13
14
Section 1. Section 465.1894, Florida Statutes, is created 15
to read: 16
465.1894 Administration of medications.— 17
(1) A pharmacist, at the direction of a physician licensed 18
under chapter 458 or chapter 459, who meets the following 19
qualifications may administer medications to a patient during a 20
life-threatening emergency event at a Level I, Level II, or 21
pediatric trauma center when delegated to perform such task: 22
(a) The pharmacist has completed an accredited 23
postgraduate residency training program; or 24
(b) The pharmacist has completed at least 3 years of 25

direct patient care in a hospital setting. 26

A trauma center that permits a physician to delegate the 28
administration of medication to a pharmacist must maintain 29
records pursuant to s. 395.0197(5) including, but not limited 30
to, documentation that the administering pharmacist meets the 31
requirements of this section. 32
(2) The board shall adopt rules to administer this 33
section. 34
Section 2. Paragraph (b) of subsection (1) of section 35
395.0197, Florida Statutes, is amended to read: 36
395.0197 Internal risk management program.— 37
(1) Every licensed facility shall, as a part of its 38
administrative functions, establish an internal risk management 39
program that includes all of the following components: 40
(b) The development of appropriate measures to minimize 41
the risk of adverse incidents to patients, including, but not 42
limited to: 43
1. Risk management and risk prevention education and 44
training of all nonphysician personnel as follows: 45
a. Such education and training of all nonphysician 46
personnel as part of their initial orientation; and 47
b. At least 1 hour of such education and training annually 48
for all personnel of the licensed facility working in clinical 49
areas and providing patient care, except those persons licensed 50

as health care practitioners who are required to complete 51
continuing education coursework pursuant to chapter 456 or the 52
respective practice act. 53
2. A prohibition, except when emergency circumstances 54
require otherwise, against a staff member of the licensed 55
facility attending a patient in the recovery room, unless the 56
staff member is authorized to attend the patient in the recovery 57
room and is in the company of at least one other person. 58
However, a licensed facility is exempt from the two-person 59
requirement if it has: 60
a. Live visual observation; 61
b. Electronic observation; or 62
c. Any other reasonable measure taken to ensure patient 63
protection and privacy. 64
3. A prohibition against an unlicensed person from 65
assisting or participating in any surgical procedure unless the 66
facility has authorized the person to do so following a 67
competency assessment, and such assistance or participation is 68
done under the direct and immediate supervision of a licensed 69
physician and is not otherwise an activity that may only be 70
performed by a licensed health care practitioner. 71
4. Development, implementation, and ongoing evaluation of 72
procedures, protocols, and systems to accurately identify 73
patients, planned procedures, and the correct site of the 74
planned procedure so as to minimize the performance of a 75

surgical procedure on the wrong patient, a wrong surgical 76
procedure, a wrong-site surgical procedure, or a surgical 77
procedure otherwise unrelated to the patient's diagnosis or 78
medical condition. 79
5. For a Level I, Level II, or pediatric trauma center, 80
development, implementation, and ongoing evaluation of 81
procedures, protocols, and systems to permit and comply with 82
pharmacist administration of medications to a patient during a 83
life-threatening emergency event, if the facility permits the 84
delegation of such task pursuant to s. 465.1894. 85
Section 3. This act shall take effect July 1, 2026. 86
