Section 1. Section 186.801, Florida Statutes, is amended 24
to read: 25

186.801 Ten-year site plans.— 26
(1) Each electric utility shall submit to the Public 27
Service Commission a 10-year site plan which estimates its 28
anticipated demand, shall estimate its power-generating needs, 29
the impact of planned demand-side management measures on such 30
generating needs, and the general location of its proposed power 31
plant sites. The 10-year plan must shall be submitted and 32
reviewed at least and submitted not less frequently than every 2 33
years. 34
(2) Within 9 months after the receipt of a 10-year site 35
the proposed plan, the commission shall issue a final order 36
approving, approving with amendments, or rejecting make a 37
preliminary study of such plan and classify it as "suitable" or 38
"unsuitable." The commission may suggest alternatives to the 39
plan. 40
(a) When deciding whether to approve a 10-year site plan, 41
the commission shall make a determination whether the plan is 42
reasonable and in the best interest of the utility's customers 43
and this state. 44
(b) The commission may reject a 10-year site plan if it 45
fails to satisfy the requirements of this section and commission 46
rules. 47
(c) Within 60 days after the receipt of a final order 48
rejecting a 10-year site plan, an electric utility shall submit 49
a revised plan to the commission for approval. 50

(d) The commission shall hold a public hearing for a 10-51
year site plan submitted by a public utility as defined in s. 52
366.02. 53
(e) The commission may hold a public hearing for a 10-year 54
site plan submitted by any electric utility upon a petition or 55
request for a hearing. Notwithstanding chapter 120 or any other 56
law, the commission shall grant the petition or request if 57
participation by the party submitting the petition or request is 58
in the public interest and will not unduly impair the efficiency 59
or administration of the proceeding. 60
(3) All findings of the commission shall be made available 61
to the Department of Environmental Protection for its 62
consideration at any subsequent electrical power plant site 63
certification proceedings. 64
(4) It is recognized that 10-year site plans submitted by 65
an electric utility are tentative information for planning 66
purposes only and may be amended and submitted for approval at 67
any time at the discretion of the utility upon written 68
notification to the commission. An electric utility may not file 69
an A complete application for certification of an electrical 70
power plant site under chapter 403 that, when such site is not 71
designated in the current 10-year site plan of the applicant, 72
shall constitute an amendment to the 10-year site plan. 73
(5) In its review preliminary study of each 10-year site 74
plan, the commission shall consider all of the following such 75

plan as a planning document and shall review: 76
(a) The need, including the need as determined by the 77
commission, for electrical power in the area to be served. 78
(b) The adequacy and cost-effectiveness of planned 79
generation, transmission, and distribution resources relative to 80
other available options. 81
(c) The benefits of energy resources sited within this 82
state that reduce this state's reliance on energy and fuels 83
imported from outside this state. 84
(d) The impact of the plan on future regulatory risks and 85
compliance costs and the impacts of those risks and costs on the 86
utility's customers. 87
(e) The adequacy of total demand-side management measures 88
proposed by the utility to mitigate its need for new generation. 89
(f)(b) The effect on fuel diversity within this the state. 90
(g)(c) The anticipated environmental impact of each 91
proposed electrical power plant site. 92
(h)(d) Possible alternatives to the proposed plan, 93
including alternative technologies for proposed resources. 94
(i)(e) The views of appropriate local, state, and federal 95
agencies, including the views of the appropriate water 96
management district as to the availability of water and its 97
recommendation as to the use by the proposed plant of salt water 98
or fresh water for cooling purposes. 99
(j)(f) The extent to which the plan is consistent with the 100

state comprehensive plan. 101
(k)(g) The plan with respect to the information of the 102
state on energy availability and consumption. 103
(l)(h) The amount of renewable energy resources the 104
utility produces or purchases. 105
(m)(i) The amount of renewable energy resources the 106
utility plans to produce or purchase over the 10-year planning 107
horizon and the means by which the production or purchases will 108
be achieved. 109
(n)(j) A statement describing how the production and 110
purchase of renewable energy resources impact the utility's 111
present and future capacity and energy needs. 112
(6)(3) In order to enable it to carry out its duties under 113
this section, the commission may, after hearing, establish an 114
administrative a study fee which may shall not exceed $100,000 115
$1,000 for each proposed plan studied. 116
(7)(4) The commission may adopt rules governing the method 117
of submitting, processing, and approving studying the 10-year 118
plans as required by this section, including the required 119
contents and approval of such plans and procedures for 120
intervention and discovery in the plan review proceedings. 121
Section 2. This act shall take effect July 1, 2026. 122
