An act relating to advanced wastewater treatment; 2
providing legislative findings; requiring certain 3
sewage disposal facilities to submit specified reports 4
to the Department of Environmental Protection; 5
requiring the department, in consultation with water 6
management districts and sewage disposal facilities, 7
to submit specified reports to the Governor and 8
Legislature and to post such reports on its website; 9
providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12

Section 1. (1) The Legislature finds that the discharge 14
of inadequately treated wastewater and aging sewage disposal 15
facilities compromise the quality of the environment, including 16
freshwater, brackish water, and nearshore and offshore salt 17
waters, and threatens the quality of life and local economies in 18
the state that depend on those resources. The Legislature 19
further finds that requiring advanced wastewater treatment or 20
better at all sewage disposal facilities with a permitted 21
capacity of greater than 1 million gallons per day in this state 22
is a necessary long-term investment that will fundamentally 23
improve wastewater treatment. 24
(2) By July 1, 2027, and annually thereafter, sewage 25

disposal facilities with a permitted capacity of greater than 1 26
million gallons per day in this state must report to the 27
Department of Environmental Protection all of the following: 28
(a) Year of construction for the facility and any 29
maintenance or upgrades. 30
(b) Total permitted volume of water treated daily. 31
(c) Actual permitted volume of water treated daily, 32
including the most recent 1 year and 5 year averages. 33
(d) Current level of treatment, including concentrations 34
for each of the following: 35
1. Biochemical oxygen demand. 36
2. Suspended solids. 37
3. Total nitrogen. 38
4. Total phosphorus. 39
5. Perfluorooctanoic acid. 40
6. Perfluorooctanesulfonic acid. 41
7. Molybdenum. 42
8. Other contaminants of emerging concern as determined by 43
the department. 44
(e) Estimated total pollutant loading based on permitted 45
volume and concentrations. 46
(f) Disposal methods and the volume discharged to any 47
receiving waterbodies, if applicable, pursuant to s. 48
403.064(16), Florida Statutes. 49
(g) Total volume and concentration of any permitted and 50

nonpermitted wastewater spills since 2010. 51
(h) Elevation of the facility and supporting 52
infrastructure. 53
(i) Location within a floodplain, flood zone, or coastal 54
high-hazard area and, if applicable, the corresponding zone 55
number. 56
(3) In order to prioritize the upgrade of sewage disposal 57
facilities and investments in wastewater infrastructure, by 58
December 31, 2027, and annually thereafter, the Department of 59
Environmental Protection, in consultation with the water 60
management districts and sewage disposal facilities, shall 61
submit to the Governor, the President of the Senate, and the 62
Speaker of the House of Representatives a report detailing all 63
of the following for all sewage disposal facilities with a 64
permitted capacity of greater than 1 million gallons per day in 65
this state and post the annual report on its website: 66
(a) Year of construction for the facility and any 67
maintenance or upgrades. 68
(b) Total permitted volume of water treated daily. 69
(c) Actual permitted volume of water treated daily, 70
including the most recent 1 year and 5 year averages. 71
(d) Current level of treatment, including concentrations 72
for each of the following: 73
