Be It Enacted by the Legislature of the State of Florida: 21

Section 1. Section 461.0182, Florida Statutes, is created 23
to read: 24
461.0182 Interstate Podiatric Medical Licensure Compact; 25

public records and meetings exemptions.— 26
(1) A podiatric physician's personal identifying 27
information, other than the podiatric physician's name, 28
licensure status, licensure number, obtained from the 29
coordinated information system, as described in Article VIII of 30
s. 461.0181, and held by the department or the board is exempt 31
from s. 119.07(1) and s. 24(a), Art. I of the State Constitution 32
unless the state that originally reported the information to the 33
coordinated information system authorizes the disclosure of such 34
information by law. If disclosure is so authorized, such 35
information may be disclosed only to the extent authorized by 36
the law of the reporting state. 37
(2)(a) A meeting or a portion of a meeting of the 38
Interstate Podiatric Medical Licensure Compact Commission or the 39
executive committee or other committee of the commission, 40
established in Article XI of s. 461.0181, at which matters 41
specifically exempted from disclosure by federal or state law 42
are discussed is exempt from s. 286.011 and s. 24(b), Art. I of 43
the State Constitution. 44
(b) Recordings, minutes, and records generated during an 45
exempt meeting or portion of such a meeting are exempt from s. 46
119.07(1) and s. 24(a), Art. I of the State Constitution. 47
(3) This section is subject to the Open Government Sunset 48
Review Act in accordance with s. 119.15 and shall stand repealed 49
on October 2, 2031, unless reviewed and saved from repeal 50

through reenactment by the Legislature. 51
Section 2. (1) The Legislature finds that it is a public 52
necessity that a podiatric physician's personal identifying 53
information, other than the podiatric physicians name, licensure 54
status, or licensure number, obtained from the coordinated 55
information system, as described in Article VIII of s. 461.0181, 56
Florida Statutes, and held by the Department of Health or the 57
Board of Podiatric Medicine be made exempt from s. 119.07(1), 58
Florida Statutes, and s. 24(a), Article I of the State 59
Constitution. Protection of such information is required under 60
the Interstate Podiatric Medical Licensure Compact, which a 61
state must adopt in order to become a member state of the 62
compact. Without the public records exemption, this state will 63
be unable to effectively implement and administer the compact. 64
(2)(a) The Legislature finds that it is a public necessity 65
that any meeting of the Interstate Podiatric Medical Licensure 66
Compact Commission or the executive committee or other committee 67
of the commission held as provided in s. 461.0181, Florida 68
Statutes, in which matters specifically exempted from disclosure 69
by federal or state law are discussed be made exempt from s. 70
286.011, Florida Statutes, and s. 24(b), Article I of the State 71
Constitution. 72
(b) The Interstate Podiatric Medical Licensure Compact 73
requires the closure of any meeting, or any portion of a 74
meeting, of the Interstate Podiatric Medical Licensure Compact 75

Commission or the executive committee or other committee of the 76
commission if the presiding officer announces in a public 77
meeting that, in connection with the performance of the 78
commission's duties, the commission must discuss certain 79
sensitive and confidential subject matters. In the absence of a 80
public meetings exemption, this state would be prohibited from 81
becoming a member state of the compact. 82
(3) The Legislature also finds that it is a public 83
necessity that the recordings, minutes, and records generated 84
during a meeting held as provided in s. 491.022, Florida 85
Statutes, which is exempt from public meetings requirements be 86
made exempt from s. 119.07(1), Florida Statutes, and s. 24(a), 87
Article I of the State Constitution. Release of such information 88
would negate the public meetings exemption. As such, the 89
Legislature finds that the public records exemption is a public 90
necessity. 91
Section 3. This act shall take effect on the same date 92
that HB 1213 or similar legislation takes effect, if such 93
legislation is adopted in the same legislative session or an 94
extension thereof and becomes a law. 95
