s. 483.823, F.S.; requiring that applicants for 7
licensure as a technologist or technician who meet 8
specified criteria be deemed to have satisfied minimum 9
qualifications for licensure to perform high or 10
moderate complexity testing as a technologist or 11
technician, as applicable; providing an effective 12

Be It Enacted by the Legislature of the State of Florida: 15

Section 1. Section 483.815, Florida Statutes, is amended 17
to read: 18
483.815 Application for clinical laboratory personnel 19
license.— 20
(1) An application for a clinical laboratory personnel 21
license must shall be made under oath on forms provided by the 22
department and must shall be accompanied by payment of fees as 23
provided by this part. Applicants for licensure must also submit 24
to background screening in accordance with s. 456.0135. A 25

license may be issued authorizing the performance of procedures 26
of one or more categories. 27
(2) An applicant who qualifies for licensure under s. 28
483.823(3) or (4) must provide proof of such qualification, 29
submit to background screening in accordance with s. 456.0135, 30
and pay the fees required under s. 483.807 to be eligible for 31
licensure. 32
Section 2. Subsections (3) and (4) are added to section 33
483.823, Florida Statutes, to read: 34
483.823 Qualifications of clinical laboratory personnel.— 35
(3) Except as otherwise provided in s. 483.812, a 36
technologist or technician applicant for licensure who satisfies 37
the requirements in 42 C.F.R. s. 493.1489 to perform high 38
complexity testing is deemed to have satisfied the minimum 39
qualifications for licensure under this part to perform high 40
complexity testing as a technologist or technician in this 41
state. 42
(4) Except as otherwise provided in s. 483.812, a 43
technician applicant for licensure who satisfies the 44
requirements in 42 C.F.R. s. 493.1423 to perform moderate 45
complexity testing is deemed to have satisfied the minimum 46
qualifications for licensure under this part to perform moderate 47
complexity testing as a technician in this state. 48
Section 3. This act shall take effect July 1, 2026. 49
