An act relating to towing undrivable vehicles; 2
creating s. 323.003, F.S.; providing requirements when 3
a motor vehicle is disabled due to a motor vehicle 4
crash; requiring a law enforcement officer and wrecker 5
operator to provide specified information to the 6
driver of the vehicle; requiring a wrecker operator 7
storage facility to provide certain notification to 8
the owner of the vehicle at specific intervals; 9
providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12
13
Section 1. Section 322.003, Florida Statutes, is created 14
to read: 15
323.003 Towing disabled vehicles; notification.— 16
(1) When a motor vehicle is disabled due to a motor 17
vehicle crash and a wrecker operator is needed to tow the 18
vehicle: 19
(a) If law enforcement is impounding the vehicle, a law 20
enforcement officer shall provide the driver with a list of 21
wrecker operators the driver may choose from; or 22
(b) The driver may call a wrecker operator of his or her 23
choice. 24
(2) The law enforcement officer and the wrecker operator 25

shall inform the driver of the vehicle storage charge per day, 26
the telephone number and e-mail address of the wrecker operator 27
storage facility to which the vehicle is being towed, and the 28
process for the owner to retrieve the vehicle. 29
(3) The wrecker operator storage facility shall notify the 30
owner of the vehicle in writing by certified mail and by 31
telephone and text message 14 business days, 30 business days, 32
and 45 business days after the vehicle arrives at the facility 33
stating that the vehicle is in storage and accruing daily 34
storage charges. 35
Section 2. This act shall take effect July 1, 2026. 36
