for specified patient information for the Parkinson's 4
disease registry; authorizing certain information to 5

for future legislative review and repeal of the 7
exemption; providing a statement of public necessity; 8
providing a contingent effective date. 9

Be It Enacted by the Legislature of the State of Florida: 11

Section 1. Section 1004.43521, Florida Statutes, is 13
created to read: 14
1004.43521 Parkinson's disease registry; public records 15
exemption.— 16
(1) Information held in the Parkinson's disease registry 17
under s. 1004.4352 which identifies a patient is confidential 18
and exempt from s. 119.07(1) and s. 24(a), Art. I of the State 19
Constitution. 20
(2) Such information may be disclosed to the following: 21
(a) The Parkinson's Disease Research Board. 22
(b) A private entity that the board has contracted with to 23
establish and maintain the registry if such entity agrees to: 24
1. Submit a research plan to the board which specifies the 25

exact nature of the information requested and the intended use 26
of the information; 27
2. Maintain the confidentiality of the records or 28
information if personal identifying information is made 29
available to the entity; 30
3. Destroy any confidential records or information 31
obtained after the research is concluded; and 32
4. Not directly or indirectly contact, for any purpose, 33
any patient. 34
(3) This section is subject to the Open Government Sunset 35
Review Act in accordance with s. 119.15 and shall stand repealed 36
on October 2, 2031, unless reviewed and saved from repeal 37
through reenactment by the Legislature. 38
Section 2. The Legislature finds that is a public 39
necessity that information held in the Parkinson's disease 40
registry under s. 1004.4352, Florida Statutes, which would 41
identify a patient be made confidential and exempt from s. 42
119.07(1), Florida Statutes, and s. 24(a), Article I of the 43
State Constitution. Such personal identifying health care 44
information, if publicly available, could be used to invade the 45
personal privacy of the individual identified in the registry. 46
The Legislature finds that the disclosure of such information 47
could hinder the effective and efficient administration of the 48
registry. Further, the Legislature finds that access to such 49
information could be used to solicit or harass an individual 50

identified in the registry. Therefore, the Legislature finds 51
that information held in the Parkinson's disease registry which 52
would identify a patient should be confidential and exempt from 53
public records requirements. 54
Section 3. This act shall take effect on the same date 55
that HB 1443 or similar legislation takes effect, if such 56
legislation is adopted in the same legislative session or an 57
extension thereof and becomes a law. 58
