Be It Enacted by the Legislature of the State of Florida: 12

Section 1. Paragraph (g) is added to subsection (2) of 14
section 943.03102, Florida Statutes, as created by HB 1471, 2026 15
Regular Session, to read: 16
943.03102 Designation of terrorist organizations.— 17
(g) Any portion of the information provided under this 18
subsection by the Chief of Domestic Security to the Governor and 19
Cabinet which would reveal information critical to state or 20
national security is exempt from s. 119.07(1) and s. 24(a), Art. 21
I of the State Constitution. This paragraph is subject to the 22
Open Government Sunset Review Act in accordance with s. 119.15 23
and shall stand repealed on October 2, 2031, unless reviewed and 24
saved from repeal through reenactment by the Legislature. 25

Section 2. (1) Section 943.03102, Florida Statutes, 26
requires the Chief of Domestic Security to provide written 27
notice and findings to the Governor and Cabinet before 28
designating an organization as a domestic terrorist organization 29
or a foreign terrorist organization. To allow the chief to 30
fulfill his or her role in making such a designation, the chief 31
must consult with local, state, and federal law enforcement 32
agencies; counter-terrorism organizations; and national security 33
organizations and receive national and domestic security 34
information that is highly sensitive in nature. For purposes of 35
public safety, the Legislature intends to keep such information 36
exempt from disclosure. 37
(2) The Legislature finds that it is a public necessity 38
that any portion of information contained in the chief's written 39
notice and findings provided to the Governor and Cabinet before 40
designating an organization as a domestic terrorist organization 41
or a foreign terrorist organization which would reveal 42
information critical to state or national security be made 43
exempt from s. 119.07(1), Florida Statutes, and s. 24(a), 44
Article I of the State Constitution. 45
Section 3. This act shall take effect on the same date 46
that HB 1471 or similar legislation takes effect, if such 47
legislation is adopted in the same legislative session or an 48
extension thereof and becomes a law. 49
