Be It Enacted by the Legislature of the State of Florida: 17

Section 1. Paragraphs (c) through (n) of subsection (4) of 19
section 322.142, Florida Statutes, are redesignated as 20
paragraphs (d) through (o), respectively, a new paragraph (c) is 21
added to that subsection, and subsections (5) through (8) are 22
added to that section, to read: 23
322.142 Color photographic or digital imaged licenses.— 24
(4) The department may maintain a film negative or print 25

file. The department shall maintain a record of the digital 26
image and signature of the licensees, together with other data 27
required by the department for identification and retrieval. 28
Reproductions from the file or digital record are exempt from 29
the provisions of s. 119.07(1) and may be made and issued only: 30
(c) For the purpose of fraud prevention, identity 31
verification, or ensuring the integrity and security of 32
individual identities, with the licensee's consent, for use by: 33
1. A state agency pursuant to an interagency agreement 34
with the department. 35
2. A third party that has entered into a contract with the 36
department to perform identity verification services for persons 37
or entities, regulated by a state agency, pursuant to standards 38
and safeguards established by the department. 39
(5) An identity verification service provider may use 40
department data in a manner consistent with this section if such 41
data remains in the department's possession. 42
(6) Any revenue generated as a result of an agreement 43
authorized by this section shall be deposited into the Highway 44
Safety Operating Trust Fund. 45
(7) An identify verification service provider may not 46
retain Internet protocol addresses, geolocation data, or other 47
information that describes the location, computer, computer 48
system, or computer network from which an applicant accesses the 49
system. 50

(8) A third party may not store or sell images, 51
signatures, or data used pursuant to this section without the 52
licensee's consent. 53
Section 2. This act shall take effect July 1, 2026. 54
