An act relating to a review under the Open Government 2
Sunset Review Act; amending ss. 319.1414, 319.25, 3
320.861, and 322.71, F.S., which provide exemptions 4
from public record requirements for information 5
received by the Department of Highway Safety and Motor 6
Vehicles as a result of an investigation or 7
examination conducted pursuant to certain provisions; 8
removing the scheduled repeal dates of the exemptions; 9
providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12
13
Section 1. Subsection (5) of section 319.1414, Florida 14
Statutes, is amended to read: 15
319.1414 Department-authorized private rebuilt inspection 16
providers; investigations; examinations; proceedings; subpoenas 17
and other process; witnesses; oaths; rules.— 18
(5) Information received by the department as a result of 19
an investigation or examination conducted pursuant to this 20
section is confidential and exempt from s. 119.07(1) and s. 21
24(a), Art. I of the State Constitution until the investigation 22
or examination ceases to be active or administrative action 23
taken by the department has concluded or been made part of a 24
hearing or court proceeding. The department may release 25

information that is made confidential and exempt under this 26
subsection in furtherance of its official duties and 27
responsibilities or, if released to another governmental agency, 28
in the furtherance of that agency's official duties and 29
responsibilities. This subsection is subject to the Open 30
Government Sunset Review Act in accordance with s. 119.15 and 31
shall stand repealed on October 2, 2026, unless reviewed and 32
saved from repeal through reenactment by the Legislature. 33
Section 2. Subsection (7) of section 319.25, Florida 34
Statutes, is amended to read: 35
319.25 Cancellation of certificates; investigations; 36
examinations; proceedings; subpoenas and other process; 37
witnesses; oaths; rules.— 38
(7) Information received by the department as a result of 39
an investigation or examination conducted pursuant to this 40
section is confidential and exempt from s. 119.07(1) and s. 41
24(a), Art. I of the State Constitution until the investigation 42
or examination ceases to be active or administrative action 43
taken by the department has concluded or been made part of a 44
hearing or court proceeding. The department may release 45
information that is made confidential and exempt under this 46
subsection in furtherance of its official duties and 47
responsibilities or, if released to another governmental agency, 48
in the furtherance of that agency's official duties and 49
responsibilities. This subsection is subject to the Open 50

Statutes, is amended to read: 55

section is confidential and exempt from s. 119.07(1) and s. 60
24(a), Art. I of the State Constitution until the investigation 61

hearing or court proceeding. The department may release 64
information that is made confidential and exempt under this 65
subsection in furtherance of its official duties and 66
responsibilities or, if released to another governmental agency, 67
in the furtherance of that agency's official duties and 68

an investigation or examination conducted pursuant to this 78
section is confidential and exempt from s. 119.07(1) and s. 79
24(a), Art. I of the State Constitution until the investigation 80
or examination ceases to be active or administrative action 81
taken by the department has concluded or been made part of a 82
hearing or court proceeding. The department may release 83
information that is made confidential and exempt under this 84
subsection in furtherance of its official duties and 85
responsibilities or, if released to another governmental agency, 86
in the furtherance of that agency's official duties and 87
responsibilities. This subsection is subject to the Open 88
Government Sunset Review Act in accordance with s. 119.15 and 89
shall stand repealed on October 2, 2026, unless reviewed and 90
saved from repeal through reenactment by the Legislature. 91
Section 5. This act shall take effect upon becoming a law. 92
