An act relating to a review under the Open Government 2
Sunset Review Act; amending s. 119.0712, F.S., which 3
provides an exemption from public record requirements 4
for certain information held by the Department of 5
Military Affairs stored in a United States Department 6
of Defense system of records, transmitted using a 7
United States Department of Defense network or 8
communications device, or pertaining to the United 9
States Department of Defense; extending the scheduled 10
repeal date of the exemption; providing an effective 11
date. 12

Be It Enacted by the Legislature of the State of Florida: 14

Section 1. Subsection (4) of section 119.0712, Florida 16
Statutes, is amended to read: 17
119.0712 Executive branch agency-specific exemptions from 18
inspection or copying of public records.— 19
(4) DEPARTMENT OF MILITARY AFFAIRS.—Information held by 20
the Department of Military Affairs that is stored in a United 21
States Department of Defense system of records, transmitted 22
using a United States Department of Defense network or 23
communications device, or pertaining to the United States 24
Department of Defense, pursuant to 10 U.S.C. s. 394, is exempt 25

from s. 119.07(1) and s. 24(a), Art. I of the State 26
Constitution. Any information not made exempt by this subsection 27
may be disclosed only after the department makes any redactions 28
in accordance with applicable federal and state laws. This 29
exemption applies to information made exempt by this subsection 30
which is held by the department before, on, or after the 31
effective date of the exemption. This subsection is subject to 32
the Open Government Sunset Review Act in accordance with s. 33
119.15 and shall stand repealed on October 2, 2031 2026, unless 34
reviewed and saved from repeal through reenactment by the 35
Legislature. 36
Section 2. This act shall take effect upon becoming a law. 37
