8 providing for future legislative review and repeal of
9 the exemption; providing a statement of public
10 necessity; providing a contingent effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Paragraph (a) of subsection (2) of section
15 943.03102, Florida Statutes, as created by SB 1632, 2026 Regular
16 Session, is amended to read:
17 943.03102 Designation of terrorist organizations.—
18 (2)(a)
1.
At least 7 days before making a designation under
19 subsection (1), the Chief of Domestic Security must provide
20 written notice to the Governor and Cabinet of his or her intent
21 to designate an organization as a domestic terrorist
22 organization or a foreign terrorist organization, which notice
23 must be accompanied by written findings regarding the basis for
24 such designation.

Any portion of the information provided under
26
subparagraph 1. which would reveal information critical to state
27
or national security is exempt from s. 119.07(1) and s. 24(a),
28
Art. I of the State Constitution. This subparagraph is subject
29
to the Open Government Sunset Review Act in accordance with s.
30
119.15 and shall stand repealed on October 2, 2031, unless
31
reviewed and saved from repeal through reenactment by the
32
Legislature.
33 Section 2.
(1)
Section 943.03102, Florida Statutes,
34
requires the Chief of Domestic Security to provide written
35
notice and findings to the Governor and Cabinet before
36
designating an organization as a domestic terrorist organization
37
or a foreign terrorist organization. To allow the chief to
38
fulfill his or her role in making such a designation, the chief
39
must consult with local, state, and federal law enforcement
40
agencies; counter-terrorism organizations; and national security
41
organizations and receive national and domestic security
42
information that is highly sensitive in nature. For purposes of
43
public safety, the Legislature intends to keep such information
44
exempt from disclosure.

(2)
The Legislature finds that it is a public necessity
46
that any portion of information contained in the chief’s written
47
notice and findings provided to the Governor and Cabinet before
48
designating an organization as a domestic terrorist organization
49
or a foreign terrorist organization which would reveal
50
information critical to state or national security be made
51
exempt from s. 119.07(1), Florida Statutes, and s. 24(a),
52
Article I of the State Constitution.
53 Section 3. This act shall take effect on the same date that
54 SB 1632 or similar legislation takes effect, if such legislation
55 is adopted in the same legislative session or an extension
56 thereof and becomes a law.
