Rules for Vessels in State Commercial Harbors

This bill clarifies and expands the exemptions for certain vessels from securing mooring lines at state commercial harbors.

What This Bill Does

  • Clarifies that certain types of vessels are exempt from securing mooring lines at state commercial harbors.

Who It Names or Affects

  • Vessel owners and operators who use state commercial harbors.
  • Government agencies responsible for transportation and maritime safety.

Terms To Know

Mooring lines
Ropes or cables used to secure a vessel in place at a dock, wharf, pier, quay, or landing.
Commercial harbors
Harbors that are used for commercial activities such as shipping and fishing.

Limits and Unknowns

  • The bill does not specify how the exemptions will be enforced.
  • It is unclear what happens if a vessel falls into an ambiguous category between exempt and non-exempt.
  • The effective date of July 1, 3000, suggests this might be a placeholder for a future actual implementation date.

Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

Hawaii published version HD1

Plain English: This amendment clarifies that certain types of labor, such as work done at shipyards or involving government-owned vessels, are exempt from the requirement to use unionized labor when securing mooring lines in state commercial harbors.

  • Adds an exemption for labor performed by or on behalf of ship repair and construction companies, including activities related to ship repair, construction, overhaul services, and maritime research and development.
  • Clarifies that government-owned or sponsored vessels, training vessels, and fishing vessels are exempt from the requirement to use unionized labor when securing mooring lines.
  • The amendment specifies future effective date of July 1, 3000, which seems unusual and may be a placeholder for an actual implementation date.
  • It is unclear how this will affect existing contracts as the text does not provide specific details on contract protections.
