Spearfishing Safety Warning Requirements

This bill requires spearfishing equipment sold, leased, rented, or commercially distributed in Hawaii to display a safety warning about the risks associated with breath-hold diving.

What This Bill Does

  • Requires any speargun or pole spear sold, leased, rented, or otherwise commercially distributed for use in Hawaii to have a safety warning about hypoxic risk and shallow-water blackout dangers.
  • Specifies that the warning must be permanently affixed, conspicuous, legible, and appear in English and additional languages as determined by the Department of Health based on demographic data.
  • Allows exemptions for traditional handcrafted or homemade fishing implements not sold commercially and private non-commercial transfers of spearfishing equipment.
  • Gives the Department of Health authority to create rules about the size, format, placement of warnings, educational materials for distributors, and exemptions.

Who It Names or Affects

  • Retailers, lessors, rental operators, and other commercial distributors of spearguns or pole spears in Hawaii.
  • The public who use spearfishing equipment.

Terms To Know

hypoxia
A condition where the body does not have enough oxygen to function properly, which can lead to loss of consciousness or death.
shallow-water blackout
A dangerous situation that occurs when a breath-hold diver runs out of air and loses consciousness due to lack of oxygen.

Limits and Unknowns

  • The bill does not apply to traditional, handcrafted, or homemade fishing implements not sold commercially.
  • It is unclear how the Department of Health will determine additional languages for the warning based on demographic data.
  • The effectiveness and compliance with these safety warnings are yet to be seen.

STATE OF HAWAII

A BILL FOR AN ACT

relating
to spearfishing safety
.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.

The legislature finds that breath-hold diving
associated with spearfishing presents a risk of hypoxia, including
shallow-water blackout, which may result in loss of consciousness, serious injury,
or death.

The legislature further finds
that increased public awareness of hypoxic risk has been shown to reduce
preventable drowning incidents.

The legislature recognizes that
spearfishing is a lawful activity in the State and includes traditional, cultural,
subsistence, and recreational practices.

Therefore, the purpose of this Act
is to promote public health and safety through clear risk disclosure, without restricting
lawful fishing practices or traditional uses, by establishing safety-warning
requirements regarding spearfishing.

SECTION 2.

through a commercial transaction; or
