Plain English Breakdown

The official source material does not provide specific details on funding for grants and loans or the exact geographic boundaries for each priority level.

Rules for Cesspool Upgrades

This bill changes the deadlines for upgrading, converting, or connecting cesspools to a better wastewater system based on their priority level.

What This Bill Does

  • Sets December 31, 2050 as the deadline for all priority 1 cesspools to be upgraded, converted, or connected to a sewerage system.
  • Phases deadlines for lower priority cesspools: Priority 2 by 2060, Priority 3 by 2070, and Priority 4 by 2080.
  • Requires the Director of Health to work with counties to classify all cesspools into one of four priority levels based on their risk to public health and environment.
  • Allows the Department of Health to create rules for defining geographic boundaries for each priority level and maintaining an updated list of cesspool priorities.

Who It Names or Affects

  • Homeowners with cesspools who need to upgrade or connect them by certain deadlines.
  • The Department of Health which will set rules and priorities for upgrading cesspools.
  • Counties that must work with the Department of Health on prioritizing and classifying cesspools.

Terms To Know

Cesspool
An underground pit where household waste water is stored before it seeps into the ground.
Priority Level
A ranking system used by the Department of Health to determine which cesspools need upgrading first based on their risk to public health and environment.

Limits and Unknowns

  • The bill does not specify what happens if a homeowner cannot upgrade, convert, or connect their cesspool by the deadline.
  • It is unclear how much funding will be available for grants and loans to help homeowners with upgrades.
  • The exact geographic boundaries for each priority level are yet to be defined.

HOUSE OF REPRESENTATIVES

H.B. NO.

THIRTY-THIRD LEGISLATURE, 2026

STATE OF HAWAII

A BILL FOR AN ACT

relating
to cesspools
.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.

The legislature finds that Act 125, Session
Laws of Hawaii 2017, requires the upgrade, conversion, or connection to a sewer
system of all cesspools statewide by 2050.

Act 153, Session Laws of Hawaii 2022, subsequently recognized the classifications
of priority 1, priority 2, and priority 3 cesspools identified by the
university of Hawaii's 2021 Hawaii cesspool hazard assessment and prioritization
tool.

The legislature further finds that
counties and homeowners face substantial financial, workforce, and
infrastructure limitations that make the current deadline unattainable.

A revised, phased timeline will allow the
State and counties to address the highest-risk cesspools first while allowing
adequate time for planning and funding of long-term wastewater solutions.

The purpose of this Act is to amend
the deadlines for the upgrade, conversion, or connection of cesspools by priority
classes, establishing December 31, 2050, as the date by which priority 1 cesspools
must be upgraded, converted, or connected, and phasing the deadlines for lower priority
cesspools in later years.
