A BILL FOR AN ACT
RELATING
TO the relocation of facilities
.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION
1.
�
(a)
�
There is established a facilities relocation
task force to consist of the following members:
����
(1)
�
A representative from the department of human
services;
����
(2)
�
A representative from the department of
health;
����
(3)
�
A representative from the department of corrections
and rehabilitation;
����
(4)
�
Mayor of the city and county of Honolulu, or their
designee;
����
(5)
�
Chairperson of the Honolulu city council, or
their designee;
����
(6)
�
Chief of the Honolulu police department, or
their designee;
����
(7)
�
Director of the city and county of Honolulu department
of planning and permitting, or their designee;
����
(8)
�
Prosecuting attorney of the city and county of
Honolulu, or their designee;
����
(9)
�
Executive secretary of the neighborhood commission
office of the city and county of Honolulu;
���
(10)
�
Chairperson of the Waianae coast neighborhood board;
���
(11)
�
Chairperson of the Nanakuli-Maili neighborhood
board;
���
(12)
�
Executive director of Partners in Care Oahu,
or their designee;
���
(14)
�
The chair of the house committee on human services;
and
���
(15)
�
The chair of the senate committee on health
and human services.
����
(b)
�
The task force shall investigate the issue of
the inequitable amount of mental health facilities, clean and sober homes,
homeless shelters, and supportive living homes, and the prevalence of these
facilities and homes along the Waianae coast.
�
The investigation shall include, but is not limited to:
����
(1)
�
Identification of the location of mental
health facilities, clean and sober homes, homeless shelters, and other
supportive living homes on the Waianae coast;
����
(2)
�
Identification of methods to address the
inequitable placement of mental health facilities, clean and sober homes,
homeless shelters, and other supportive living homes across the island of Oahu;
����
(3)
�
Collaboration with stakeholders on issues such
as:
���������
(A)
�
The proximity of supportive living homes to
children, elderly, recreation areas, and other supportive living homes;
����
����
(B)
�
Transparency;
���������
(C)
�
Liability insurance;
���������
(D)
�
Lack of Honolulu police department and department
of planning and permitting of the city and county of Honolulu resources;
���������
(E)
�
Oversight;
���������
(F)
�
Community engagement; and
���������
(G)
�
The density of supportive living homes in
areas in relation to population density to ensure equitable access to these
facilities across the State;
����
(4)
�
Propose legislation that would allow for the more
equitable placement of mental health facilities, clean and sober homes,
homeless shelters, and other supportive living homes across the island of Oahu;
and
����
(5)
�
Identification of any fiscal implications to
the State and propose mechanisms to mitigate impact.
����
(c)
�
The task force shall submit a preliminary
report of its findings to the legislature no later than twenty days prior to
the convening of the regular session of 2027.
����
(d)
�
The task force shall submit the final report
of its findings and recommendations, including any proposed legislation no
later than twenty days prior to the convening of the regular session of
2028.
�
����
(e)
�
The task force shall service until it has
accomplished the purpose of this Act or twenty days prior to the convening of
the regular session of 2028, whichever occurs first.
����
(f)
�
The members of the task force shall serve
without compensation but shall be reimbursed by the department of human
services for necessary expenses, including travel expenses, incurred for
service on the task force.
�
No member of
the task force shall be made subject to section 84-17, Hawaii Revised Statutes,
solely because of that member's participation on the task force.
�
The task force shall be exempt from chapter
92, Hawaii Revised Statutes.
����
(g)
�
The chair of the house committee on human
services, or the chair's designee, and the chair of the senate committee on health
and human services, or the chair's designees, shall convene the task
force.
�
The task force shall be
administratively supported by the department of the human services.
����
SECTION
2.
�
There is an appropriated amount of
the general revenues of the State of Hawaii in the sum of $
�

����
or so much thereof as may be necessary for
fiscal year 2026-2027 for the purposes of this Act.
����
The sum
appropriated shall be expended by the department of human services for the
purposes of this Act.
����
SECTION
3.
�
This Act shall take effect upon its
approval.
