Exempting Small Homeowner-Developers from Annual Reports

This bill changes the law to exempt homeowners who develop no more than two units, one for personal residence and another sold initially, from filing annual reports and paying fees.

What This Bill Does

  • Changes the requirement that developers file an annual report and pay a $50 fee if they have developed only up to two units.
  • Requires one of these units to be where the developer lives as their main home for at least ten years.
  • Specifies that the other unit must have been sold initially.
  • Exempts such homeowners from filing further annual reports and paying fees after meeting these conditions.
  • Amends Hawaii Revised Statutes section 514B-58 to include this exemption.

Who It Names or Affects

  • Homeowners who develop no more than two units under a condominium property regime
  • Developers of small-scale residential projects

Terms To Know

Developer
A person or company that creates and sells new housing developments.
Condominium Property Regime
An arrangement where multiple units in a building are individually owned but shared common areas are jointly managed by all unit owners.

Limits and Unknowns

  • The bill only applies to developments with no more than two units.
  • It is unclear how the law will be enforced or what happens if conditions change after exemption.
  • Effective date of July 1, 3000 suggests this might be a placeholder for an actual future date.

H.B. NO.

THIRTY-THIRD LEGISLATURE, 2025

STATE OF HAWAII

A BILL FOR AN ACT

RELATING
TO CONDOMINIUMS
.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.

The legislature finds that homeowners who
subdivide their property into as few as two units under a condominium property
regime are considered developers under chapter 514B, Hawaii Revised
Statutes.

Section 514B-58, Hawaii
Revised Statutes, requires developers to file an annual report and pay a
corresponding annual fee of $50 until all units have been sold.

This law has unduly burdened
homeowner-developers who permanently reside in one of the units and therefore
cannot satisfy the requirement of selling every unit, which would otherwise
eliminate the need to file an annual report and pay the annual fee.

The purpose of this Act is to
relieve from the burden of filing annual reports and paying the corresponding
annual $50 filing fee those individual homeowners whose development consists of
no more than two units, one in which the developer resides and one for which
the initial sale of the other unit has been completed.

SECTION
2
.

Section
514B-58, Hawaii Revised Statutes, is amended by amending subsection (b) to read
as follows:

"(b)

The developer, its successor, or assign shall
be relieved from filing
subsequent
annual reports pursuant to this
section [
when
]
after filing an annual report notifying that
the
initial sales of all units have been completed[
.
]
, including any
development:

(1)

That consists
of no more than two units;

(2)

In which one of
the units is the principal place of residence of the developer, its successor,
or its assign; and

(3)

For which the
initial sale of the other unit has been completed.
"

SECTION 3.

Statutory material to be repealed is
bracketed and stricken.

New statutory
material is underscored.

SECTION 4.

This Act shall take effect upon its approval.
