Plain English Breakdown

The bill summary does not provide details about enforcement or monitoring procedures.

Campaign Contribution Rules

This bill changes rules about how much cash people can give to political candidates in Hawaii during an election period.

What This Bill Does

  • Amends the law so that if someone gives more than $100 in cash to a candidate, candidate committee, or noncandidate committee during an election period and it's not returned within 30 days, the extra money goes to Hawaii's election campaign fund.

Who It Names or Affects

  • Candidates running for office in Hawaii
  • Campaign committees supporting candidates or issues in Hawaii
  • People who give cash contributions to political campaigns in Hawaii

Terms To Know

Contribution limit
The maximum amount of money that can be given by one person to a candidate, committee, or campaign during an election period.
Escheat
When property or funds are transferred from a private individual to the state because it was not returned as required by law.

Limits and Unknowns

  • The bill does not specify what happens if contributions are made in ways other than cash.
  • It is unclear how strictly this new rule will be enforced and monitored.

Amendments

SD1

Hawaii published version SD1

Plain English: This amendment changes the rules about returning excess campaign contributions, making it so that any extra money over $100 in cash must be returned to the donor within 30 days; if not, it goes to the Hawaii election campaign fund.

  • Adds a requirement for candidates and committees to return excess cash contributions of more than $100 to donors within 30 days or have them go to the state's election campaign fund.
  • The amendment text does not specify what happens if the contribution is less than $100 but still over the limit set by other sections of Hawaii Revised Statutes, which may cause confusion.
