Rules for Retired Teachers Rehiring

This bill changes the rules for retired teachers who want to return to work in teacher shortage areas or hard-to-fill positions, requiring a six-month break in service and prohibiting extra employment benefits.

What This Bill Does

  • Changes the break in service requirement from twelve months to six months for retired teachers rehired as teachers or administrators in teacher shortage areas or hard-to-fill positions.
  • Requires that rehired retired teachers receive at least the minimum salary for their experience and qualifications.
  • Prohibits rehired retired teachers from receiving additional employment benefits typically given to active employees.

Who It Names or Affects

  • Retired teachers who want to return to work in teaching or administrative roles in teacher shortage areas or hard-to-fill positions.
  • School districts and charter schools hiring retired teachers for difficult-to-fill positions.
  • The Department of Education, which must create rules to identify teacher shortage areas and hard-to-fill positions.

Terms To Know

Retirant
A person who has retired from a job but may be rehired under certain conditions.
Teacher Shortage Area
An area where there is a lack of qualified teachers, as identified by the Department of Education.

Limits and Unknowns

  • The bill does not specify how to determine 'difficult-to-fill positions'.
  • It is unclear when and how the rules for identifying teacher shortage areas will be implemented.
  • The effective date listed (7/1/3000) appears to be a placeholder or error.

Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

HD1

1

Hawaii published version HD1

Plain English: This amendment allows retired teachers to be rehired in certain hard-to-fill positions without losing their retirement benefits, but they cannot receive additional employment benefits.

  • Retired teachers can now be rehired as teachers or administrators in areas with a shortage of educators or in hard-to-fill positions identified by the Department of Education.
  • The amendment removes restrictions on hiring retired teachers within twelve months after leaving state employment, provided no pre-retirement agreements exist for their return to work.
  • Employers must contribute to the pension fund based on the rehired teacher's compensation.
  • The exact details of how 'hard-to-fill positions' are defined and identified by the Department of Education remain unspecified in this amendment text.
HD2

3

Hawaii published version HD2

Plain English: This amendment changes the requirement that retired teachers must wait six months before they can be rehired in certain positions, and it also stops these rehired retirees from getting extra employment benefits.

  • Changes the waiting period for retired teachers to return as teachers or administrators in shortage areas or hard-to-fill positions from twelve months to six months.
  • Adds a provision that prohibits rehired retirants from receiving additional employment benefits typically given to active employees.
  • The amendment specifies an effective date of July 1, 3000, which seems unusual and may be a placeholder or error in the text.
  • Details on how the Department of Education will identify teacher shortage areas and hard-to-fill positions are not provided.
