amended to read as follows:

(a)

Except as provided in section 387-9 and this section, every employer
shall pay to each employee employed by the employer, wages at the rate of not
less than:

$6.25 per hour beginning January 1,
2003;

$6.75 per hour beginning January 1,
2006;

(3)

$7.25 per hour beginning January 1,
2007;

(4)

$7.75 per hour beginning January 1,

$8.50 per hour beginning January 1,

tips is at least $7.00 more than the applicable minimum wage.

No later than December 31, 2026, and each year thereafter, the
department shall calculate an adjusted tip credit amount that shall take effect
on January 1 of the following year; provided that the adjusted tip credit
amount shall equal twenty-five per cent of the effective minimum wage pursuant
to subsection (a).
