STATE OF HAWAII

A BILL FOR AN ACT

PROPOSING AN AMENDMENT TO THE constitution of the state
of hawaii TO LEGALIZE THE adult use of cannabis.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.
�
The purpose of this Act is to propose an
amendment to article XVI of the
Constitution of the
State of Hawaii to:

����
(1)
�
Authorize individuals aged twenty-one
and older to use and possess a personal-use amount of cannabis; and

����
(2)
�
Require the legislature to enact laws
governing the use, manufacture, distribution, sale, possession, regulation, and
taxation of cannabis within the State.

����
SECTION 2.
�
Article XVI of the Constitution of the State
of Hawaii is amended by adding a new section to be appropriately designated and
to read as follows:

"
CANNABIS

Section .
�
(a)
�
Subject to subsection (b), on or after July 1,
2027, an individual in the State who is at least twenty-one years old may use
and possess a personal-use amount of cannabis.

(b)
�
The legislature shall, by law, provide for the
use, manufacture, distribution, sale, possession, regulation and taxation of
cannabis within the State.
"

SECTION 3.
�
The question to be printed on the ballot
shall be as follows:

"Shall the Constitution of the
State of Hawaii be amended to:

(1)
�
Authorize individuals aged twenty-one and
older to use and possess personal-use amounts of cannabis; and

����
(2)
�
Require the legislature to enact laws
governing the use, manufacture, distribution, sale, possession, regulation, and
taxation of cannabis within the State?"

SECTION 4.
�
New constitutional material is underscored.

SECTION 5.
�
This amendment shall take effect upon
compliance with article XVII, section 3, of the Constitution of the State of
Hawaii.
