A BILL FOR AN ACT

RELATING
TO NOISE
.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.
�
The
legislature finds that the operation of privately owned and operated refuse collection
vehicles in urban areas during early morning hours causes excessive noise and
disturbs the sleep of residents.

����
Accordingly, the purpose of this Act is to
prohibit the operation of privately owned and operated refuse collection
vehicles before 6:00 a.m. and after 6:00 p.m. within five hundred feet of any area
zoned for mixed-use or residential apartment use within any county having a
population of five hundred thousand or more.

SECTION 2.
�

Chapter 324F, Hawaii Revised Statutes, is amended by adding a new
section to be appropriately designated and to read as follows:

Refuse collection vehicles;
restrictions.

(a)
�

In any urban district in the State, as designated pursuant to section
205-2, in any county having a population of five hundred thousand or more, it
shall be unlawful for any person, before 6:00 a.m. or after 6:00 p.m., to operate
a privately owned and operated refuse collection vehicle within five hundred
feet of an area zoned for mixed-use or residential apartment
use.

(b)
�
Nothing in this section shall be construed to
preempt or prohibit any county in the State from regulating the use of refuse
collection vehicles in a manner that is more stringent than the provisions of
this section.
�
In the event of a conflict
between this section and any county rule or ordinance regarding the use of
refuse collection vehicles, the more restrictive requirements shall apply.

(c)

For the purposes of this section:

"Mixed-use"
shall have the same meaning as in section 171‑36.5(f), but shall also
include community development districts.

����
"Refuse
collection vehicle" means any industrial vehicle having a gross vehicle
weight rating greater than

pounds
that is used to collect and transport garbage or other refuse.
"

SECTION 3.
�

This Act does not affect rights and duties that matured, penalties that
were incurred, and proceedings that were begun before its effective date.
