STATE OF HAWAII
SENATE RESOLUTION
requesting the department of land and natural resources to
transfer fee simple title ownership of parcels of land to
the department of agriculture and biosecurity
pursuant to act 90,
session laws of hawaii 2003
.

WHEREAS, article
XI, section 10, of the Hawaii State Constitution establishes that "the
public lands shall be used for the development of farm and homeownership on as widespread
a basis as possible, in accordance with procedures and limitations prescribed
by law"; and
����
WHEREAS, certain
public lands classified for agricultural use by the Department of Land and Natural
Resources should be transferred to the Department of Agriculture and
Biosecurity, with the approval of the Board of Land and Natural Resources and
the Board of Agriculture and Biosecurity, for purposes and in a manner
consistent with article XI, section 10, of the Hawaii State Constitution; and

WHEREAS, chapter
166E, Hawaii Revised Statutes, was codified to ensure the long-term productive
use of public lands leased or available to be leased by the Department of Land
and Natural Resources for agricultural purposes by allowing these lands to be
transferred to and managed by the Department of Agriculture and Biosecurity;
now, therefore,

BE IT
RESOLVED by the Senate of the Thirty-third Legislature of the State of Hawaii,
Regular Session of 2026, that the Department of Land and Natural Resources is
requested to transfer fee simple title ownership of parcels of land to the
Department of Agriculture and Biosecurity pursuant to Act 90, Session Laws of
Hawaii 2003; and

BE IT FURTHER
RESOLVED that the Department of Land and Natural Resources is requested to
transfer fee simple title ownership of the parcels of land identified as the
following tax map keys:

(3) 4-1-6:7 and
(3) 2-6-18:1 to the Department of Agriculture and Biosecurity; and
����
BE IT FURTHER
RESOLVED that certified copies of this Resolution be transmitted to the
Chairperson of the Board of Land and Natural Resources and Chairperson of the
Board of the Agriculture and Biosecurity.
