IDAHO
CODE
CLEANUP

LEGISLATIVE
INTENT.
It
is
the
intent

of
the
Legislature
to
ensure
that
the
state
laws
provided
in
Idaho
Code
are
21
streamlined,
up
-
to
-
date,
and
essential
for
the
citizens
of
Idaho,
while
best
22
serving
the
public
health,
safety,
and
welfare.
In
accordance
with
the
Idaho
23
Code
Cleanup
Act,
following
comprehensive
review,
the
Legislature
has
iden
-

tified
the
provisions
of
this
act
as
obsolete,
outdated,
or
unnecessary.

the
first

a

the

of
the
twelfth
month
from
the

month.
Registration
periods
shall
expire
at
midnight
on
the
22
last
day
of
the
registration
period
in
the
year
designated
by
the
validation

registration
sticker.
The
numeral
digit
on
the
validation
registration
24
stickers
shall,
as
does
the
registration
card,
fix
the
registration
period
25
under
the
staggered
registration
system
for
the
purpose
of
reregistration

and
notice
of
expiration.

A
vehicle
that
has
once
been
registered
for
any
of
the
above
-
designated

periods
shall,
upon
reregistration,
be
registered
for
the
period
bearing
the

same
number,
and
the
registration
card
shall
show
and
be
the
exclusive
proof

of
the
expiration
date
of
registration
and
licensing.
Vehicles
may
be
ini
-

tially
registered
for
less
than
a
twelve
(12)
month
period,
or
for
more
than
a

twelve
(12)
month
period,
and
the
fee
prorated
on
a
monthly
basis
if
the
frac
-
33
tional
registration
tends
to
fulfill
the
purpose
of
the
monthly
series
reg
-

istration
system.

(2)
For
all
school
buses
operated
either
by
a
nonprofit,
nonpublic

school
or
operated
pursuant
to
a
service
contract
with
a
school
district
for

transporting
children
to
or
from

shall
be

financial
institution

repossession

repossession
plate.
The

demonstrating

The

repossession
plates

be

in
subsection

the
registration

The
repossession
plate
shall
be
subject
to
staggered

the
purpose

reregistration

A
wrecker
or
towing
business
engaged
in
the
process
of
towing
motor
-

ized
vehicles
that
have
been
wrecked,
abandoned,
salvaged
or
may
be
disabled

may
apply
for
a
wrecker
plate
to
be
displayed
on
those
vehicles
being
towed,
29
provided
the
power
unit
is
properly
registered
under
this
chapter.
The
reg
-

istration
fees
for
wrecker
plates
shall
be
as
required
in
subsection
(1)

plate

subject
to
staggered
registration
for
the
purpose

reregistration

notice
of
expiration.
The
initial
program
fee
and
the

annual
program
fee
shall
be
deposited
in
the
state
highway
account
and
shall

be
used
to
fund
the
cost
of
administration
of
special
license
plate
programs,

unless
otherwise
specified
by
law.

Any
vehicle
that
does
not
meet
federal
motor
vehicle
safety
stan
-

dards
shall
not
be
registered
and
shall
not
be
permitted
to
operate
on
public

highways
of
the
state,
as
defined
in

Idaho
Code,
unless
oth

specifically
authorized.

In
addition
to
annual
registration
fees
as
provided
in

registrants
may
pay
a
fee
to
purchase
an
Idaho
state
parks
passport

authorizing
resident
motor
vehicle
entry
into
all
Idaho
state
parks.
Reg

istrants
may
pay
the
fee
for
a
one
(1)
year
or
two
(2)
year
period
of
time.

The
fee
shall
be
ten
dollars
($10.00)
for
one
(1)
year
and
twenty
dollars

($20.00)
for
two
(2)
years.
All
fees
collected
pursuant
to
this
subsection
20
shall
be
deposited
into
the
park
and
recreation
fund
and
shall
be
subject
to

appropriation.
Fees
collected
pursuant
to
this
subsection
shall
not
be
con

sidered
a
motor
vehicle
registration
fee
as
provided
in
section
17,
article

VII
of
the
constitution
of
the
state
of
Idaho.

That
Section

(1)
Any
motor
vehicle
manufactured

that

maintained
to
its

likeness
using

be
known
as

an
"Idaho
Old
Timer."
Any
motor
vehicle
which
is
altered
from
its
original

design
is
not
an
"Idaho
Old
Timer"
as
herein
defined.

vehicle
which
qualifies
as
an
"Idaho
Old
Timer"
shall
be

used
for
exhibits,
parades,
tours,
club

by
representatives
of
the

existing
plate
design
will
be
canceled

holders,

purchase
and

applicant
for
the
special
"Idaho
Old
Timer"
plate
shall
execute

an
affidavit
on
a
form
provided
by
the
department
that
the
vehicle
qualifies

as
an
old
timer
and
shall
only
be
used
for
the
purposes
allowed.

The
department
shall
have
the
authority
to
refuse
to
issue
a
plate
and
23
may
demand
the
return
of
such
plate
if
the
applicant
has
failed
to
comply
with
24
the
provisions
of
this
section.

(6)
If
an
"Idaho
Old
Timer"
is
to
be
used
as
customary
and
usual
trans
-
26
portation,
or
for
business
or
commercial
purposes,
the
owner
shall
register
27
the
vehicle
under
the
provisions
of
section
49
-
402,
or
section
49
-
434,
Idaho
28
Code,
as
applicable,
and
shall
obtain
and
display
the
standard
issue
of
li
-
29
cense
plates
after
payment
of
the
plate
fee
required
in
section
49

Idaho

Code.
It
shall
be
permissible
to
display
both
the
standard
issue
of
plates

and
the
special
"Idaho
Old
Timer"
plate.

Whenever
title
or
interest
in
an
Old
Timer
vehicle

transferred

retain

plates

The

cost
of
each
plate
will
be
charged
to
each
plate
holder
who
pur

new
plate.
If
a
new
plate
design
is
authorized,
the
design
and

color
shall
be
approved
by
representatives
of
the
interest
group.
The
de
-

sign,
color
and
numbering
scheme
shall
also
be
subject
to
the
approval
of
the

department.
The
existing
plate
design
will
be
canceled
and
all
plate
hold
-

ers,
present
and
future
shall
purchase
and
display
the
new
plate.

An
applicant
for
the
special
"Idaho
Classic"
plate
shall
execute
an

affidavit
on
a
form
provided
by
the
department
that
the
vehicle
or
motorcycle

qualifies
as
an
"Idaho
Classic"
and
shall
only
be
used
for
the
purposes
al
-

lowed.

The
department
shall
have
the
authority
to
refuse
to
issue
the
plate
and

may
demand
the
return
of
such
plate
if
the
applicant
has
failed
to
comply
with

the
provisions
of
this
section.

If

"Idaho
Classic"
is
to
be
used
as
customary
and
usual
trans

portation,
or
for
business
or
commercial
purposes,
the
owner
shall
register

the
vehicle
under
the
provisions
of

Code,
as
applicable,
and
shall
obtain
and
display
the
standard
issue
of

cense
plates
after
payment
of
the
plate
fee
required
in

It
shall

permissible

display
both
the
standard
issue
of
plates

and
the
"Idaho
Classic"
plate.

Whenever
title

interest
in
an
Idaho
classic
motor
vehicle

transferred

assigned,
the
transferor
may
retain
the
special

plate

use
on
another

in

by
paying

SECTION
13.
An
emergency
existing
therefor,
which
emergency
is
hereby

declared
to
exist,
this
act
shall
be
in
full
force
and
effect
on
and
after
10
July
1,
2026.
