It
Enacted
by
the
Legislature
of
the
State
of
Idaho:
25
SECTION
1.
LEGISLATIVE
INTENT.
It
is
the
intent
of
the
Legislature
that
26
on
and
after
July
1,
2030,
electrical,
plumbing,
and
HVAC
inspections
no
27
longer
be
performed
by
the
Division
of
Occupational
and
Professional
Li
-
28
censes.
Instead,
the
Legislature
finds
that
it
would
be
advantageous
and
29
more
efficient
for
such
inspections,
if
not
being
otherwise
provided
for
by
30
local
jurisdictions,
to
be
performed
by
private
inspectors
who
are
certified
31
by
the
Division
of
Occupational
and
Professional
Licenses.
32
This
legislation
provides
for
a
transition
period
between
October
1,
33
2026,
and
July
1,
2030.
During
the
transition
period,
electrical,
plumb
-
34
ing,
and
HVAC
inspections
may
be
performed
either
by
state
inspectors
or
by
35
state
-
certified
private
inspectors.
36
It
is
further
the
intent
of
the
Legislature
that
nothing
in
this
act
37
shall
be
construed
to
alter
or
repeal
any
building,
electrical,
plumbing,
or
38
HVAC
code
adopted
by
the
state
or
any
political
subdivision.
Any
inspection
39
conducted
pursuant
to
this
act
shall
comply
with
the
applicable
code
in
ef
-
40
fect
at
the
time
of
inspection.

SECTION
2.
That
Chapter
26,
Title
67,
Idaho
Code,
be,
and
the
same
is
42
hereby
amended
by
the
addition
thereto
of
a
NEW
SECTION
,
to
be
known
and
des
-
43
ignated
as
Section
67
-
2616,
Idaho
Code,
and
to
read
as
follows:

2616.
STATE
-
CERTIFIED
PRIVATE
INSPECTORS.
(1)
On
and
after
October
45
1,
2026,
the
division
shall
implement
a
program
to
provide
for
the
certifica
-
46
tion
of
private
electrical,
plumbing,
and
heating,
ventilation,
and
air
con
-
47
3
ditioning
(HVAC)
inspectors
that
allows
for
private
inspectors
to
apply
to
1
the
division
to
become
certified
to
conduct
electrical,
plumbing,
and
HVAC
2
inspections.
A
person
desiring
a
certification
to
perform
inspections
as
a
3
state
-
certified
private
inspector
shall
make
an
application
for
such
certi
-
4
fication
to
the
division
in
the
form
to
be
prescribed
by
the
division.
An
5
original
application
for
a
private
inspector
certification
or
a
reinstate
-
6
ment
shall
be
accompanied
by
a
fee
not
to
exceed
one
hundred
twenty
-
five
dol
-
7
lars
($125).

Electrical
inspectors
who
apply
for
certification
as
state
-
certi
-
9
fied
private
inspectors
shall
be
certified
if
they
are
qualified
pursuant
10
to
section
54
-
1019,
Idaho
Code.
Before
applying
for
a
certification
to
per
-
1
1
form
electrical
inspections,
the
applicant
shall
provide
the
division
with
12
a
passing
score
on
the
applicable
international
code
council
electrical
in
-
13
spector
exam
or
any
other
inspector
exam
determined
by
the
electrical
board
14
to
be
substantially
equivalent.
15
(3)
Plumbing
inspectors
who
apply
for
certification
as
state
-
certified
16
private
inspectors
shall
be
certified
by
the
division
if
they
are
qualified
17
pursuant
to
section
54
-
2627,
Idaho
Code.
Before
applying
for
a
certifica
-
18
tion
to
perform
plumbing
inspections,
the
applicant
shall
provide
the
divi
-
19
sion
with
a
passing
score
on
the
international
association
of
plumbing
and
20
mechanical
officials
plumbing
inspector
exam
or
any
other
inspector
exam
de
-
21
termined
by
the
plumbing
board
to
be
substantially
equivalent.

(4)
HVAC
inspectors
who
apply
for
certification
as
state
-
certified
23
private
inspectors
shall
be
certified
by
the
division
if
they
are
qualified
24
pursuant
to
section
54
-
5021(2)
and
(3),
Idaho
Code.
Before
applying
for
a
25
certification
to
perform
HVAC
inspections,
the
applicant
shall
provide
the
26
division
with
a
passing
score
on
the
international
code
council
mechanical
27
inspector
exam
or
any
other
inspector
exam
determined
by
the
HVAC
board
to
be
28
substantially
equivalent.
29
(5)
Certifications
issued
by
the
division
pursuant
to
this
section
30
shall
be
valid
for
three
(3)
years.
The
renewal
fee
for
a
certification
is
-
31
sued
pursuant
to
this
section
shall
not
exceed
one
hundred
dollars
($100).

(6)
The
division
shall
maintain
and
make
available
to
the
public
a
reg
-
33
istry
of
state
-
certified
private
inspectors
and
the
types
of
inspections
34
that
such
inspectors
are
certified
to
perform.
35
(7)
A
local
jurisdiction
shall
not
be
required
to
provide
for
state
-
36
certified
private
inspectors.
However,
a
local
jurisdiction
that
provides
37
for
state
-
certified
private
inspectors
to
perform
inspections
shall
not
re
-
38
quire
a
state
-
certified
private
inspector
to
obtain
any
additional
certifi
-
39
cation
or
registration
or
require
payment
of
any
fees
in
order
for
any
state
-
40
certified
private
inspector
to
conduct
inspections
within
the
local
juris
-
41
diction.
A
local
jurisdiction
that
authorizes
the
use
of
state
-
certified
42
private
inspectors
shall
be
held
harmless
from
any
and
all
liability
relat
-
43
ing
to
delays
or
lack
of
availability
of
state
-
certified
private
inspectors.
44
(8)
A
state
-
certified
private
inspector
shall
carry
proof
of
state
cer
-
45
tification
whenever
such
inspector
is
conducting
an
inspection.
It
shall
be
46
unlawful
for
any
person
to
act
as
a
state
-
certified
private
inspector
if
such
47
person
is
not
certified
by
the
division
of
occupational
and
professional
li
-
48
censes.
Notwithstanding
any
other
provision
of
law,
a
state
-
certified
pri
-
49
vate
inspector
shall
not
be
required
to
maintain
any
underlying
trade
li
-
50
4
cense
solely
to
perform
the
work
of
providing
state
-
certified
private
in
-
1
spections.

(9)
The
division
shall
be
authorized
to
take
any
appropriate
action
3
against
a
state
certification,
subject
to
the
provisions
of
chapter
52,
ti
-
4
tle
67,
Idaho
Code,
in
any
of
the
following
circumstances:
5
(a)
An
inspector
employed
fraud
or
deception,
made
a
misrepresentation
6
or
misstatement,
or
employed
any
unlawful
means
in
applying
for
or
se
-
7
curing
certification
as
an
inspector;
8
(b)
An
inspector
has
been
convicted
of
or
has
engaged
in
conduct
consti
-
9
tuting
a
violation
of
public
laws,
ordinances,
or
rules
of
this
state,
10
or
any
subdivision
thereof,
relevant
to
inspections;

1
(c)
An
inspector
has
engaged
in
any
other
conduct
whether
of
the
same
12
or
a
different
character
than
described
in
this
subsection
that
consti
-
13
tutes
dishonest
or
dishonorable
dealings;
14
(d)
An
inspector
has
been
adjudged
mentally
incompetent
by
a
court
of
15
competent
jurisdiction;
or
16
(e)
An
inspector
interfered
with
an
investigation
or
disciplinary
pro
-
17
ceeding
by
a
willful
misrepresentation
of
facts
or
by
the
use
of
threats
18
or
harassment
against
any
person
to
prevent
such
person
from
providing
19
evidence
in
a
disciplinary
proceeding,
investigation,
or
other
legal
20
action
instituted
in
accordance
with
this
chapter.

(10)
A
state
-
certified
private
inspector
shall
conduct
an
inspection
22
pursuant
to
the
applicable
code
in
effect
at
the
time
of
any
such
inspection.
23
(11)
A
state
-
certified
private
inspector
shall
not
conduct
an
inspec
-
24
tion
relating
to
electrical,
plumbing,
or
HVAC
work
occurring
on
property
25
that
the
inspector
or
a
related
person
has
a
direct
or
indirect
ownership
in
-
26
terest
in
or
for
work
that
was
performed
by
or
under
the
supervision
of:
27
(a)
Such
inspector;
28
(b)
A
related
person;
or
29
(c)
A
person
employed
or
contracted
by
a
business
in
which
the
inspec
-
30
tor
or
a
related
person
has
a
direct
or
indirect
economic
interest.
As
31
used
in
this
section,
"related
person"
means
an
inspector's
employee,
32
employer,
business,
business
partner,
business
associate,
or
any
per
-
33
son
related
to
the
inspector
by
affinity
within
the
first
degree.

(12)
Between
October
1,
2026,
and
June
30,
2030,
the
division
shall
em
-
35
ploy
state
inspectors
and
shall
provide
for
the
certification
of
private
in
-
36
spectors.
On
and
after
July
1,
2030,
the
division
shall
no
longer
conduct
37
electrical,
plumbing,
or
HVAC
inspections
or
employ
inspectors
for
such
pur
-
38
poses.

(13)
The
division
may
promulgate
rules,
subject
to
legislative
ap
-
40
proval,
to
effectuate
the
provisions
of
this
section.

SECTION
3.
That
Section
54
-
1001B,
Idaho
Code,
be,
and
the
same
is
hereby

amended
to
read
as
follows:

STATE
INSPECTION
PROVISIONS
INAPPLICABLE
WHEN
INSTALLATION

COVERED
BY
MUNICIPAL
ORDINANCE.
(1)
The
provisions
of
this
chapter
relat
-

ing
to
state
inspection
,
except
as
provided
in
section
54
-
1001C,
Idaho
Code,
46
shall
not
apply:
47
(a)
Within
cities
or
counties
that,
by
ordinance
or
building
code,
pre
-
48
scribe
the
manner
in
which
wires
or
equipment
to
convey
current
and
ap
-
49
5
paratus
to
be
operated
by
such
current
shall
be
installed,
provided
that
1
the
provisions
of
the
Idaho
electrical
code
are
used
as
the
standard
in
2
the
preparation
of
such
ordinances
or
building
codes
and
provided
that
3
actual
inspections
are
made;
or
4
(b)
Within
cities
or
counties
that
receive
inspections
from
another
5
city
or
county
that
conducts
inspections
pursuant
to
paragraph
(a)
of
6
this
subsection,
provided
that
the
provisions
of
the
Idaho
electrical
7
code
shall
be
used
as
the
standard
for
such
inspections.

(2)
A
city
or
county
that
conducts
electrical
code
enforcement
inspec
-
9
tions
shall
do
so
only
in
compliance
with
the
provisions
of
this
section.

(3)
A
city
or
county
that
has
not
previously
instituted
and
implemented
1
1
an
electrical
code
enforcement
program
prior
to
the
effective
date
of
this
12
act
may
elect
to
implement
such
a
program
by
passing
an
ordinance
evidencing
13
the
intent
to
do
so.
A
city
or
county
may
contract
with
a
public
or
private
14
entity
to
administer
its
electrical
code
enforcement
program
pursuant
to
the
15
provisions
of
this
section.

(4)
A
city
or
county
that
chooses
to
conduct
its
own
electrical
code
en
-
17
forcement
inspections
or
to
receive
such
inspections
from
another
city
or
18
county
shall
provide
the
division
of
occupational
and
professional
licenses
19
notice
of
such
decision
in
writing
at
least
thirty
(30)
days
prior
to
imple
-
20
mentation.

(5)
A
city
or
county
that
terminates
a
permitting
and
inspection
pro
-
22
gram
established
pursuant
to
this
section
shall
notify
the
division
of
oc
-
23
cupational
and
professional
licenses
in
writing
of
its
intent
to
terminate
24
such
program.
Upon
termination
of
a
city
or
county
permitting
and
inspection
25
program,
the
division
of
occupational
and
professional
licenses
shall
pro
-
26
vide
electrical
code
enforcement
services
in
the
jurisdiction
for
a
minimum
27
of
one
(1)
year.

(6)
Notwithstanding
any
provision
of
law
to
the
contrary,
on
and
af
-
29
ter
July
1,
2030,
inspections
under
the
state
electrical
code
shall
be
con
-
30
ducted
by
state
-
certified
private
inspectors
if
not
otherwise
provided
for
31
by
a
city
or
county
pursuant
to
the
provisions
of
this
section.

with

by
such
other

states.
The
administrator,
on
the
recommendation
of
the
Idaho
electrical

board,
may
grant
licenses
to
electricians
licensed
by
such
other
states
upon

payment
by
the
applicant
of

required
fee
and

furnishing
proof
to
the

board
that
the
applicant
has
qualifications
at
least
equal
to
those
provided

herein
for
applicants

written
examinations.
Applicants
who
qualify
for

subsection
are
not
required
to

certain

construction,
in

improvement,
extension,

alteration
of
materials,
piping,

venting,
fixtures,
appliances,
and
appurtenances
in
relation
to
plumbing

and
plumbing
systems
and
to
provide
that
all
plumbing
and
plumbing
systems

in
the
state
shall
be
designed,
constructed,
installed,
improved,
extended,

and
altered
in
substantial
accord
with
the
uniform
plumbing
code
published

by
the
international
association
of
plumbing
and
mechanical
officials
and
as

it
shall

compiled,
and
published
from
time
to
time
and

subsequent
editions,
amendments,

revisions
thereto
shall
be
adopted

by
the
Idaho
plumbing
board
through
the
negotiated
rulemaking

Any

modifications

to
the
uniform
plumbing
code

the
board
shall
be
made
by
administrative
rules
promulgated
by
the
board,

subject
to
legislative
approval.
The
uniform
plumbing
code
together
with

amendments,

modifications

by
the
board
shall

lectively
constitute
and

named
the
Idaho
state
plumbing
code.
The
board

shall
conduct
a
minimum
of
two

hearings
with

Cities

counties

board

its
adoption.

Cities
or
counties
may
further
amend
the
Idaho
state
plumbing
code

adopted
by
the
board
in
conformance
with
this
section
to
address
local
con
-

cerns
as
long
as
such
amendments
prescribe
at
least
an
equivalent
level
of

protection
to
that
contained
in
the
uniform
plumbing
code.
Provided
how
-

ever,
that
no
code
other
than
the
uniform
plumbing
code
together
with
any
40
amendments,
revisions,
or
modifications
made
by
the
board
that
collectively
41
constitute
the
Idaho
state
plumbing
code
may
serve
as
the
standard
for
plumb
-
42
ing
installations
in
such
city
or
county.
A
city
or
county
electing
to
amend
43
the
Idaho
state
plumbing
code
as
adopted
by
the
board
may
do
so
only
after
a
44
finding
by
the
city
or
county
that
good
cause
exists
for
such
an
amendment
45
and
that
such
amendment
is
reasonably
necessary.
Prior
to
making
a
finding

of
good
cause
for
such
an
amendment,
the
city
or
county
shall
conduct
a
pub

lic
hearing.
Notice
of
the
time
and
place
of
the
public
hearing
shall
be

may
perform
plumbing

enforcement
activities

cities

standard
for
plumbing
code
enforcement
activities

section.

A
city

county
that
has
not
previously
instituted

implemented

a
plumbing
code
enforcement
program
prior
to
the
effective
date
of
this

tion
may
elect
to
implement
such
a
program
by
passing

ordinance

so.
A
city
or
county
may
contract
with
a
public
or
private

entity
to
administer
its
plumbing
code
enforcement
program
pursuant
to
the

provisions

this
section.

Summon
witnesses

this
chapter.
No
person
shall
be
required
to

testify
outside

county
wherein
he
resides
or

his
principal

business

located.
Such
summons
to
testify
shall
be
issued

and
served
in
like
manner
as
a
subpoena
to
witness
issued
from
the
dis
-

trict
court
or
in
other
manner
consistent
with
the
procedure
of
the

division
of
occupational
and
professional
licenses.
In
case
any
wit

POWERS

THE

LIMITATION.
(1)
The
board

shall
have
the
general
administration
and
supervision
of
the
design,
con

struction,
installation,
improvement,
extension,
and
alteration
of
heat

ing,
ventilation,
and
air
conditioning
systems,
except
that
which
has
been
26
heretofore
and
hereinafter
exempted
from
the
jurisdiction
of
this
board,
in
27
connection
with
all
buildings,
residences,
and
structures
in
this
state,
in
-
28
cluding
buildings,
residences,
and
structures
owned
by
the
state
or
any
po
-
29
litical
subdivision
thereof.
The
division
of
occupational
and
professional
30
licenses
shall
enforce
the
minimum
standards
and
requirements
therefor
as
31
provided
by
this
chapter.
The
board
may
exercise
such
powers
and
duties
as
32
are
reasonably
necessary
to
carry
out
the
provisions
of
this
chapter,
and
it
33
may,
among
other
things:

(a)
Hold
public
meetings
and
attend
or
be
represented
at
such
meetings,
35
within
or
without
the
state,
promulgate
rules,
subject
to
legislative
36
approval,
pertaining
to
this
chapter
and
such
other
information
as
may
37
be
necessary,
and
furnish
copies
thereof
to
those
engaged
in
the
busi
-
38
ness,
trade,
practice,
or
work
of
heating,
ventilation,
and
air
condi
-
39
tioning
and
to
the
public
upon
request;
and
40
(b)
Establish
by
administrative
rule,
subject
to
legislative
approval,
41
the
fines
to
be
paid
for
citations
issued
and
hear
appeals
regarding
the
42
imposition
of
civil
penalties
for
violations
of
this
chapter
and
rules
43
of
the
board.
The
board
is
authorized
to
affirm,
reject,
decrease,

or
increase
the
penalty
imposed
by
the
administrator.
However,
in
no

case
shall
the
penalty
exceed
one
thousand
dollars
($1,000)
for
each

OF
THE

PROFES

LICENSES.
The
administrator
shall
exercise
such
powers
and
duties
as
13
are
reasonably
necessary
to
enforce
standards
provided
in
this
chapter,
and
14
he
may,
among
other
things:
15
(1)
Serve
as
secretary
to
the
Idaho
heating,
ventilation
and
air
condi
-
16
tioning
board;
17
(2)
Provide
for
HVAC
inspections
for
another
state
or
local
jurisdic
-
18
tion
upon
request
by
an
appropriate
building
official.
Such
inspections
19
shall
be
made
in
accordance
with
the
applicable
HVAC
codes
of
the
requesting
20
jurisdiction.
Fees
charged
for
such
inspection
services
shall
be
as
pro
-
21
vided
in
the
rules
promulgated
by
the
board;
22
(3)
Summon
witnesses
to
appear
and
testify
before
him
on
any
matter
23
within
the
provisions
of
this
chapter.
No
person
shall
be
required
to
tes
-
24
tify
outside
the
county
wherein
he
resides
or
where
his
principal
place
of
25
business
is
located.
Such
summons
to
testify
shall
be
issued
and
served
in
26
like
manner
as
a
subpoena
to
witness
issued
from
the
district
court,
or
in
27
other
manner
consistent
with
procedure
of
the
division
of
occupational
and
28
professional
licenses.
In
case
any
witness
shall
fail
or
refuse
to
appear
29
and
testify
upon
being
summoned
as
herein
provided,
the
clerk
of
the
district
30
court
of
the
county
shall,
upon
demand
by
said
administrator
or
his
desig
-
31
nated
agent,
issue
a
subpoena
reciting
the
demand
therefor
and
summoning
the
32
witness
to
appear
and
testify
at
a
time
and
place
fixed.
Violation
of
such
33
subpoena
or
disobedience
thereto
shall
be
deemed
and
punished
as
a
violation

of
any
other
subpoena
issued
from
the
district
court;

Administer
oaths
and
take
affirmations
of
witnesses
appearing
be
