AN ACT concerning local government.

Be it enacted by the People of the State of Illinois,
3
represented in the General Assembly:

Section 5.
The Public Officer Prohibited Activities Act is
5
amended by changing Section 2 as follows:

Sec. 2.
No alderperson of any city, or member of the board
8
of trustees of any village, during the term of office for which
9
he or she is elected, may accept, be appointed to, or hold any
10
office by the appointment of the mayor or president of the
11
board of trustees, unless the alderperson or board member is
12
granted a leave of absence from such office, or unless he or
13
she first resigns from the office of alderperson or member of
14
the board of trustees, or unless the holding of another office
15
is authorized by law. The alderperson or board member may,
16
however, serve as a volunteer fireman
or as an emergency
17
worker
and
may
receive compensation for that service. The
18
alderperson may also serve as a commissioner of the Beardstown
19
Regional Flood Prevention District board. Any appointment in
20
violation of this Section is void. Nothing in this Act shall be
21
construed to prohibit an elected municipal official from
22
holding elected office in another unit of local government as
23
long as there is no contractual relationship between the

municipality and the other unit of local government. This
2
amendatory Act of 1995 is declarative of existing law and is
3
not a new enactment.

Section 10.
The Illinois Municipal Code is amended by

changing Section 3.1-15-15 as follows:

Sec. 3.1-15-15.
Holding other offices.
A mayor, president,

alderperson, trustee, clerk, or treasurer shall not hold any
10
other office under the municipal government during the term of
11
that office, except when the officer is granted a leave of
12
absence from that office or except as otherwise provided in
13
Sections 3.1-10-50, 3.1-35-135, and 8-2-9.1. Moreover, an
14
officer may serve as a volunteer fireman
or as an emergency
15
worker
and
may
receive compensation for that service.
