SYNOPSIS AS INTRODUCED:

105 ILCS 5/10-31 new

Amends the School Boards Article of the School Code. Requires a school
district that administers a self-report survey to its students that may
reveal personal, protected information to obtain parental or guardian
consent in writing if the student is under the age of 18 before the student
may participate in the self-report survey. Requires a school district to
afford a parent or guardian the opportunity to review, either
electronically or in person, the scope of the questions to be asked.
Provides that refusal to grant consent for a student to participate in the
self-report survey shall not be a reason for disciplinary action, academic
penalty, suspension, or expulsion or any other sanction of the student.
Effective immediately.

AN ACT concerning education.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The School Code is amended by adding Section
5
10-31 as follows:

(105 ILCS 5/10-31 new)

Sec. 10-31.
Self-report surveys.

8

(a) For purposes of this Section, "personal, protected
9
information" means any information related to any topic
10
protected under the federal Protection of Pupil Rights
11
Amendment of 1978.

(b) If a school district administers a self-report survey
13
to its students that may reveal personal, protected
14
information, no student under the age of 18 is required to take
15
or participate in the self-report survey unless parental or
16
guardian consent is given in writing. Prior to the self-report
17
survey being administered, a parent or guardian shall be
18
afforded the opportunity to review, either electronically or
19
in person, the scope of the questions to be asked. Refusal to
20
grant consent for a student to participate in the self-report
21
survey shall not be a reason for disciplinary action, academic
22
penalty, suspension, or expulsion or any other sanction of the
23
student.

Section 99.
Effective date.
This Act takes effect upon

becoming law.
