Joyce Mason SYNOPSIS AS INTRODUCED: 220 ILCS 5/16-126.2 new Amends the Electric Service Customer Choice and Rate Relief Law of 1997 of the Public Utilities Act. Provides that a public service company that is a member of a Regional Transmission Organization shall submit a report to the Illinois Commerce Commission on or before February 1 of each year of any recorded vote cast by the public service company during the immediately preceding calendar year. Provides that a public service company that is a member of a Regional Transmission Organization shall include in the report any recorded vote cast by an affiliate at a meeting of a Regional Transmission Organization during the immediately preceding calendar year. Provides that the report shall include: (i) all recorded votes cast by the public service company, regardless of whether the vote is otherwise disclosed; (ii) all votes cast by an affiliate of the public service company, if the public service company did not vote on the matter; and (iii) a brief description explaining how each vote cast by the public service company or its affiliate, as appropriate, is in the interest of the public. LRB104 10670 AAS 20749 b A BILL FOR HB1802 LRB104 10670 AAS 20749 b 1 AN ACT concerning regulation. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Public Utilities Act is amended by adding 5 Section 16-126.2 as follows: 6 (220 ILCS 5/16-126.2 new) 7 Sec. 16-126.2. Recorded votes report. 8 (a) Definitions. In this Section: 9 "Affiliate" has the meaning given in Section 7-108. 10 "Meeting" means any committee, user group, task force or 11 other part of the Regional Transmission Organization in which 12 votes are taken. 13 "Recorded vote" means any final or non-final vote that is 14 tabulated, individually or as part of a sector, for any 15 purpose at a meeting, regardless of (i) whether the vote 16 represents a final position of any entity casting a vote or 17 (ii) the decision-making authority of those voting. 18 "Regional Transmission Organization" means an entity that 19 qualifies as a Regional Transmission Organization under 18 CFR 20 35.34. 21 (b) On or before February 1 of each year, each public 22 service company that is a member of a Regional Transmission 23 Organization shall submit to the Commission a report of any HB1802 - 2 - LRB104 10670 AAS 20749 b 1 recorded vote cast by the public service company or, subject 2 to the limitation in subsection (c), an affiliate of the 3 public service company at a meeting of a Regional Transmission 4 Organization during the immediately preceding calendar year. 5 (c) The report required under subsection (b) shall include 6 (i) all recorded votes cast by the public service company, 7 regardless of whether the vote is otherwise disclosed, (ii) 8 all votes cast by an affiliate of the public service company, 9 if the public service company did not vote on the matter, and 10 (iii) a brief description explaining how each vote cast by the 11 public service company or its affiliate, as appropriate, is in 12 the interest of the public.
