AN ACT concerning local government.

Be it enacted by the People of the State of Illinois,
3
represented in the General Assembly:

Section 5.
The Public Officer Prohibited Activities Act is
5
amended by changing Section 1 as follows:

6

Sec. 1.
County board.
No member of a county board, during
8
the term of office for which he or she is elected, may be
9
appointed to, accept, or hold any office other than (i)
10
chairman of the county board or member of the regional
11
planning commission by appointment or election of the board of
12
which he or she is a member, (ii) alderperson of a city or
13
member of the board of trustees of a village or incorporated
14
town if the city, village, or incorporated town has fewer than
15
1,000 inhabitants and is located in a county having fewer than
16
50,000 inhabitants, or (iii) trustee of a forest preserve
17
district created under Section 18.5 of the Conservation
18
District Act, unless he or she first resigns from the office of
19
county board member or unless the holding of another office is
20
authorized by law. Any such prohibited appointment or election
21
is void. This Section shall not preclude a member of the county
22
board from being appointed or selected to serve as (i) a member
23
of a County Extension Board as provided in Section 7 of the

County Cooperative Extension Law, (ii) a member of an
2
Emergency Telephone System Board as provided in Section 15.4
3
of the Emergency Telephone System Act, (iii) a member of the
4
board of review as provided in Section 6-30 of the Property Tax
5
Code,
or
(iv) a public administrator or public guardian as
6
provided in Section 13-1 of the Probate Act of 1975
, or (v) a
7
member of an intergovernmental joint self-insurance pool board
8
as provided in Section 6 of the Intergovernmental Cooperation
9
Act
. Nothing in this Act shall be construed to prohibit an
10
elected county official from holding elected office in another
11
unit of local government so long as there is no contractual
12
relationship between the county and the other unit of local
13
government. This amendatory Act of 1995 is declarative of
14
existing law and is not a new enactment.

Effective date.
This Act takes effect upon

becoming law.
