AN ACT concerning health.

Be it enacted by the People of the State of Illinois,
3
represented in the General Assembly:

4

Section 5.
The Equitable Restrooms Act is amended by
5
changing Section 16 as follows:

6

(410 ILCS 35/16)
7

Sec. 16.
Adult changing station.
8

(a) In this Section:
9

"Adult changing station" means
a wheelchair accessible
10
toilet facility compliant with the federal Americans with
11
Disabilities Act of 1990 and regulations adopted under that
12
Act or
a private, enclosed family or assisted-use toilet
13
facility
, both of which shall meet all of the following
14
requirements:
15

(1) the facility contains

containing
an adult changing
16

table
that is capable of serving persons of any age;
17

(2) the facility is accessible under the federal
18

Americans with Disabilities Act of 1990 and regulations
19

adopted thereunder; and
20

(3) the facility is equipped with all of the
21

following:
22

(A) a waste receptacle;
23

(B) a toilet and a sink;

(C) a coat hook located in close proximity to the
2

changing surface;
3

(D) a soap dispenser;
4

(E) a paper towel dispenser;
5

(F) signage indicating "adult changing station" at
6

the entrance to the room;
7

(G) signage within the room indicating the weight
8

capacity and instructions for operation of the adult
9

changing table; and
10

(H) a side and end maneuvering clearance of at
11

least 36 inches
.
12

"Adult changing table" means a powered, height-adjustable
13
table that:
14

(1) has
, at a minimum, the following safety features:
15

(A)
safety rails on each side
that (i) are a
16

minimum of two-thirds of the length of the changing
17

surface, (ii) are centered, plus or minus 3 inches,
18

along the long open sides of the changing surface, and
19

(iii) are capable of being raised or lowered;
and
20

(B)
a safety belt;
21

(2) is capable of being lowered to a height of
17

19

22

inches or less and raised to a height of at least 38
23

inches;
24

(3) is at least
30

25
inches wide and at least
70

72

25

inches long; and
26

(4) supports at least 400 pounds.

"Public building" means any one or more of the following
2
if constructed on or after January 1, 2029:
3

(1) an establishment with the capacity to serve 1,500
4

or more persons per day that is not a place of education;
5

(2) a building or structure used for exhibition or
6

entertainment, including a movie theater, performance
7

theater, concert hall, convention center, sports arena or
8

stadium, shopping mall, shopping center, or a store that
9

is larger than 40,000 square feet;
10

(3) a building or structure used for public display or
11

collection, including a museum, library, or gallery;
12

(4) a building or structure that is located in a place
13

of recreation, including a park, zoo, or amusement park,
14

and that is designated by the owner or operator of that
15

place of recreation or the owner's or operator's agent as
16

a public building under this Act;
17

(5) a building or structure, not including an athletic
18

stadium, that is located in a place of education designed
19

to educate 1,500 students or more during a semester, and
20

that is designated by the owner or operator of that place
21

of education or the owner's or operator's agent as a
22

public building under this Act;
23

(6) an airport terminal;
24

(7) a bus station;
25

(8) a hospital;
26

(9) a hospital-related outpatient clinic; or

(10) a rehabilitation facility.

"State-owned building" means the State Capitol Building
, a
3
State park campground with plumbing and electricity at toilet
4
locations, a State park visitor center with plumbing and
5
electricity at toilet locations,
or a rest stop located on an
6
interstate highway.
7

(b) The owner or operator of each State-owned building
and
8
the owner or operator of each public building built after
9
January 1, 2029
shall
do all of the following:

install and
10
maintain in that building at least one adult changing station
11
that is accessible when the building is open to the public
12

(1) install a minimum of one adult changing station in
13

the building;
14

(2) maintain, repair, and replace each adult changing
15

table in the building as necessary to ensure safety and
16

ease of use;
17

(3) clean each adult changing station in the building
18

with the same frequency as the other public restrooms
19

located within the building; and
20

(4) provide sufficient floor space around the adult
21

changing table in the building to comply with the
22

requirements of the Americans with Disabilities Act
23

standards for accessible design, as prescribed in 28 CFR
24

35.151 and 36 CFR Part 1191, Appendices B and D
.
25

(c) The owner or operator of each State-owned building
and
26
the owner or operator of each public building
shall ensure

that:

(1)
except for places of education,
the entrance to
3

each restroom in the building has conspicuous signage
4

indicating the location of the adult changing stations in
5

the building
, and, for places of education, only the
6

entrance to the restroom that contains an adult changing
7

station has conspicuous signage indicating the adult
8

changing station
; and
9

(2) the central directory for the building, if such a
10

directory exists, indicates the location of the adult
11

changing stations in the building.
12

(d) The owner or operator of a place of recreation
13
described in paragraph (4) of the definition of "public
14
building" in subsection (a) or that person's agent and the
15
owner or operator of a place of education described in
16
paragraph (5) of the definition of "public building" in
17
subsection (a) or that person's agent shall designate a
18
building or structure that will serve as the public building
19
for that place of recreation or education, respectively.
