Suzanne M. Ness SYNOPSIS AS INTRODUCED: 405 ILCS 20/3c from Ch. 91 1/2, par. 303c Amends the Community Mental Health Act. In provisions permitting the removal of a community mental health board member, provides that prior to removal, the member must have an opportunity to be heard by the full membership of the governing body. Provides that after given notice and an opportunity to be heard, the member may be removed upon a 2/3 majority vote of the entire governing body of the appointing authority at a public meeting. LRB104 17604 KTG 31032 b A BILL FOR HB4616 LRB104 17604 KTG 31032 b 1 AN ACT concerning mental health. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Community Mental Health Act is amended by 5 changing Section 3c as follows: 6 (405 ILCS 20/3c) (from Ch. 91 1/2, par. 303c) 7 Sec. 3c. Any member of the community mental health board 8 may be removed by the appointing officer for absenteeism, 9 neglect of duty, misconduct or malfeasance in office, after 10 being given a written statement of the charges and an 11 opportunity to be heard thereon by the full membership of the 12 governing body. After given notice and an opportunity to be 13 heard, the member may be removed upon a 2/3 majority vote of 14 the entire governing body of the appointing authority at a 15 public meeting . 16 (Source: P.A. 77-1500 .)
