SYNOPSIS AS INTRODUCED:

720 ILCS 5/12-6.6 new

Amends the Criminal Code of 2012. Provides that a person commits
threatening another person when that person knowingly delivers or conveys,
directly or indirectly, to another person by any means, whether verbal,
written, or through social media, a communication containing: (1) a threat
that would place another person or a member of his or her immediate family
in reasonable apprehension of immediate or future bodily harm, death,
sexual assault, confinement, or restraint; or (2) a threat that would
place another person or a member of his or her immediate family in
reasonable apprehension that damage will occur to property in the custody,
care, or control of the person or his or her immediate family. Provides
that threatening another person is a Class 3 felony for a first offense and
a Class 2 felony for a second or subsequent offense. Defines "immediate
family" and "social media".

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Criminal Code of 2012 is amended by adding
5
Section 12-6.6 as follows:

(720 ILCS 5/12-6.6 new)

Sec. 12-6.6.
Threatening another person.
8

(a) In this Section:
9

"Immediate family" means a spouse, child, or children.

10

"Social media" means a service, platform, or site
11

where users communicate with one another and share media,
12

such as pictures, videos, music, and blogs, with other
13

users free of charge.

(b) A person commits threatening another person when that
15
person knowingly delivers or conveys, directly or indirectly,
16
to another person by any means, whether verbal, written, or
17
through social media, a communication containing:
18

(1) a threat that would place another person or a
19

member of his or her immediate family in reasonable
20

apprehension of immediate or future bodily harm, death,
21

sexual assault, confinement, or restraint; or
22

(2) a threat that would place another person or a
23

member of his or her immediate family in reasonable
