SYNOPSIS AS INTRODUCED:

220 ILCS 5/9-241.5 new

Amends the Public Utilities Act. Provides that a public utility shall
freeze its monthly customer charge for low-income households at an amount
equal to a percentage of the household's income that is no greater than the
current percentage of income used to determine the amount of monthly
credits administered to participants of the Percentage of Income Payment
Plan under the Energy Assistance Act.

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Public Utilities Act is amended by adding
5
Section 9-241.5 as follows:

(220 ILCS 5/9-241.5 new)

Sec. 9-241.5.
Monthly customer charge freeze.

(a) As used in this Section:

"Customer charge" means a customer's fixed utility service
10
costs, such as billing and meter readings, that do not vary
11
with the customer's usage of the utility.

"Low-income household" means a residential household with
13
annual household income at or below 135% of the poverty
14
guidelines updated periodically in the Federal Register by the
15
U.S. Department of Health and Human Services under the
16
authority of 42 U.S.C. 9902(2).

(b) A public utility shall freeze its monthly customer
18
charge for low-income households at an amount equal to a
19
percentage of the household's income that is no greater than
20
the current percentage of income used to determine the amount
21
of monthly credits administered to participants of the
22
Percentage of Income Payment Plan under subsection (c) of
23
Section 18 of the Energy Assistance Act.
