Amends the Public Radio and Television Grant Act. Changes the name of
the Act to the Public Media Grant Act. Provides that public, educational,
and government access channels are included in the grant program under the
Act. Makes changes concerning the distribution of grants under the Act.

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Public Radio and Television Grant Act is
5
amended by changing Sections 0.01, 1, 2, 3, 4, 5, 6, 7, and 8
6
as follows:

Sec. 0.01.
Short title.
This Act may be cited as the
Public
9
Media
Public Radio and Television
Grant Act.

Sec. 1.
Definitions.
As used in this Act, unless the
13
context otherwise requires:
14
"Illinois public radio station" or "radio station" means a
15
non-commercial public radio broadcasting station licensed as
16
such by the Federal Communications Commission, or authorized
17
under a program test authority by the Federal Communications
18
Commission, which operates from a community located in this
19
State, and meets the minimum criteria for receipt of Community
20
Service Grants set by the Corporation for Public Broadcasting;
21
and
22
"Illinois public television station" or "television

station" means a non-commercial public television broadcasting
2
station licensed as such by the Federal Communications
3
Commission, or authorized under a program test authority by
4
the Federal Communications Commission, which operates from a
5
community located in this State, and meets the minimum
6
criteria for receipt of Community Service Grants set by the
7
Corporation for Public Broadcasting.
8
"Public, educational, and government access channel" or
9
"PEG" means a cable-operated channel that provides community
10
programming, such as coverage of hyper-local news, high school
11
sports, and city council meetings.

"Eligible
public media outlet"
station"
means a
public,
13
educational, and government access channel or
public radio or
14
television station as defined hereinabove which had been in
15
full-time operation and has met the minimum grant criteria of
16
the Corporation for Public Broadcasting before applying for a
17
grant under this Act.
18
In the event the Corporation for Public Broadcasting
19
should cease to exist, or its Community Service Grant program
20
should terminate, or the eligibility criteria for grants under
21
the Community Service Grant program shall be lowered, then the
22
criteria for eligibility for such grants which were extant on
23
the effective date of this Act shall prevail for purposes of
24
this Act.

"Public media outlet" or "outlet",
"Station"
unless
26
otherwise qualified, means any eligible

station,
or

television station.

"Actual operating cost" means the total sum expended for
3
the operations and maintenance of an Illinois public radio or
4
television station.

Sec. 2.
Certification process.
Each eligible
outlet
8
station
shall certify to the Illinois Arts Council, in such
9
form and at such time as the Council shall require, its actual
10
operating cost for the prior fiscal year. Upon acceptance by
11
the Illinois Arts Council, such certification shall constitute
12
the basis for grants provided under this Act.

Sec. 3.
Allocation of Funds.
Funds appropriated
under this
16
Act shall be used
for the purpose of making grants to
public
17
media outlets.
stations under this Act shall be divided into 2
18
grant pools, with 75% of such appropriated funds constituting
19
a grant pool for public television stations and 25% of such
20
appropriated funds constituting a grant pool for public radio
21
stations.

Sec. 4.
Basic Grants.
Each eligible
outlet
station
shall
2
receive an annual basic service grant in an amount equal to 30%
3
of the grant pool
for which it is eligible
divided by the
4
number of eligible
outlets.

Sec. 5.
Operating Grants.
Each eligible
outlet
station
8
shall receive an annual operating support grant amounting to a
9
pro-rata share of 70% of the grant pool
for which it is
10
eligible
. This share shall bear the same ratio to 70% of the
11
grant pool
from which it came
as the
outlet's
station's
actual
12
operating cost bore in the previous fiscal year to the
13
aggregate of such actual operating cost for all eligible
14
outlets
stations
for that year.

Sec. 6.
Grant Limitations.
Notwithstanding any other
18
provision of this Act, no
outlet
station
shall in any year be
19
allocated funds under this Act in excess of one-half of its
20
actual operating cost for the prior fiscal year. Those funds
21
not obligated by virtue of this limitation shall be
22
distributed to the remaining
outlets
stations
in accordance
23
with the provisions of Section 5 of this Act.
24
Notwithstanding any other provision of this Act, no
outlet

station
shall be allocated more than 60% of all funds in its
2
grant pool. Those funds not obligated by virtue of this
3
limitation shall be distributed to the remaining eligible
4
outlets
stations
in accordance with the provisions of Section
5
5 of this Act.

Sec. 7.
Required Assurances.
Each eligible
outlet
station
9
and
, if applicable,
its
outlet
station
licensee shall certify
10
to the Illinois Arts Council when applying for grant funds
11
under this Act that any funds received pursuant to the
12
provisions of this Act shall not supplant or cause to be
13
reduced any other sources of funding for such
outlets
14
stations
, and will be used solely for the benefit of
public
15
media
a public broadcasting station
and not for general
16
institutional overhead or parent organization expenses.

Sec. 8.
Illinois Public Broadcasting Council.
There is
20
hereby created a public corporation to be called the Illinois
21
Public Broadcasting Council whose directors shall consist of
22
one representative of each
outlet
station
eligible to receive
23
grants under this Act. This Corporation shall function under
24
such bylaws as shall be written by its initial directors and

amended from time to time, provided, however, that such bylaws
2
shall be in conformity with the applicable laws of the State of
3
Illinois.

Section 99.
Effective date.
This Act takes effect upon

becoming law.
