Janet Yang Rohr SYNOPSIS AS INTRODUCED: 110 ILCS 167/21 new Amends the Public Higher Education Act. Requires a public institution of higher education to make fentanyl testing strips available free of charge through the student health center, a student wellness office, wellness kiosks, and resident assistant programs. Provides that fentanyl testing strips shall be provided in confidentiality to any enrolled student upon request. Allows a public institution of higher education to offer educational materials addressing drug overdose prevention. Effective July 1, 2026. LRB104 17824 LNS 31258 b STATE MANDATES ACT MAY REQUIRE REIMBURSEMENT MAY APPLY A BILL FOR HB4865 LRB104 17824 LNS 31258 b 1 AN ACT concerning education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Public Higher Education Act is amended by 5 adding Section 21 as follows: 6 (110 ILCS 167/21 new) 7 Sec. 21. Free fentanyl test strips; drug overdose 8 prevention educational materials. 9 (a) A public institution of higher education shall make 10 fentanyl testing strips available free of charge through the 11 student health center, a student wellness office, wellness 12 kiosks, and resident assistant programs. 13 The fentanyl testing strips shall be provided in 14 confidentiality to any enrolled student upon request. 15 (b) A public institution of higher education may offer 16 educational materials addressing drug overdose prevention. 17 Section 99. Effective date. This Act takes effect July 1, 18 2026.
