SYNOPSIS AS INTRODUCED:
20 ILCS 405/405-550 new
Amends the Department of Central Management Services Law of the Civil
Administrative Code of Illinois. Creates the Disability Benefits
Maximization Program. Provides that, within 6 months after the effective
date of the amendatory Act, the Department of Central Management Services,
in conjunction with the 5 State-funded retirement systems, shall enter
into a contract with an administrator to establish and conduct a
Disability Benefits Maximization Program to identify individuals eligible
for but not enrolled in Medicare, and to assist those individuals with
enrolling in Social Security and Medicare. Provides that the Disability
Benefits Maximization Program shall conduct an annual audit of the State
health benefits program for everyone covered under the State Employees
Group Insurance Program, the Teachers' Retirement Insurance Program, and
the College Insurance Program for the purpose of identifying participants
and their dependents who are eligible for Medicare under federal law and
shall also ensure that those annuitants, retirees, benefit recipients,
survivors, and dependents who are eligible for Medicare are enrolled in
Medicare with Medicare as their primary health care benefits coverage and
the State health benefits program being the secondary provider of their
health care benefits coverage. Provides that the Disability Benefits
Maximization Program shall assist annuitants, retirees, benefit
recipients, and their survivors and dependents who become disabled and are
not enrolled in Social Security Disability Insurance and Medicare with
enrolling in and obtaining Social Security Disability Insurance and
Medicare benefits. Provides that the administrator of the Disability
Benefits Maximization Program shall provide the Department, the 5
State-funded retirement systems, and the General Assembly with an annual
report. Effective January 1, 2027.

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Department of Central Management Services
5
Law of the Civil Administrative Code of Illinois is amended by
6
adding Section 405-550 as follows:
7

Sec. 405-550.
Disability Benefits Maximization Program.
9
(a) Within 6 months after the effective date of this
10
amendatory Act of the 104th General Assembly, the Department
11
of Central Management Services, in conjunction with the State
12
Employees' Retirement System of Illinois, the State
13
Universities Retirement System, the Teachers' Retirement
14
System of the State of Illinois, the Judges Retirement System
15
of Illinois, and the General Assembly Retirement System, shall
16
enter into a contract with a qualified and experienced
17
administrator to establish and conduct a Disability Benefits
18
Maximization Program to identify annuitants, retirees, benefit
19
recipients, and their survivors or dependents who are eligible
20
for but not enrolled in Medicare, and to assist those
21
annuitants, retirees, benefit recipients, survivors, and
22
dependents with enrollment in Social Security and Medicare.

(b) The Disability Benefits Maximization Program shall

conduct an annual audit of the State health benefits program
2
for everyone covered under the State Employees Group Insurance
3
Program, the Teachers' Retirement Insurance Program, and the
4
College Insurance Program for the purpose of identifying
5
participants and their dependents who are eligible for
6
Medicare under federal law. The Program shall also ensure that
7
those annuitants, retirees, benefit recipients, survivors, and
8
dependents who are eligible for Medicare are enrolled in
9
Medicare with Medicare as their primary health care benefits
10
coverage and the State health benefits program being the
11
secondary provider of their health care benefits coverage.

(c) The Disability Benefits Maximization Program shall
13
assist annuitants, retirees, benefit recipients, and their
14
survivors and dependents who become disabled and are not
15
enrolled in Social Security Disability Insurance and Medicare
16
with enrolling in and obtaining Social Security Disability
17
Insurance and Medicare benefits. This assistance shall
18
include, but shall not be limited to: (i) developing
19
communication materials to educate individuals about Social
20
Security Disability Insurance benefits; (ii) performing
21
multiple outreach efforts to targeted populations; (iii)
22
analyzing responses to determine Social Security Disability
23
Insurance eligibility; and (iv) representing qualified
24
individuals on their claims for Social Security Disability
25
Insurance and Medicare.

(d) The administrator shall provide the Department, the

State Employees' Retirement System of Illinois, the State
2
Universities Retirement System, the Teachers' Retirement
3
System of the State of Illinois, the Judges Retirement System
4
of Illinois, the General Assembly Retirement System, and the
5
General Assembly with an annual report showing the number of
6
annuitants, retirees, benefit recipients, survivors, and
7
dependents who are transitioned to Social Security Disability
8
Insurance and Medicare and the amount of savings realized by
9
the State of Illinois.

Section 99.
Effective date.
This Act takes effect on
11
January 1, 2027.
