Angelica Guerrero-Cuellar SYNOPSIS AS INTRODUCED: 5 ILCS 347/10 Amends the Public Official Safety and Privacy Act. Adds law enforcement officers to the definition of "public official". LRB104 16852 BDA 30262 b A BILL FOR HB5276 LRB104 16852 BDA 30262 b 1 AN ACT concerning government. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Public Official Safety and Privacy Act is 5 amended by changing Section 10 as follows: 6 (5 ILCS 347/10) 7 Sec. 10. Definitions. As used in this Act: 8 "Constitutional officers" means the officers established 9 by Section 1 of Article V of the Illinois Constitution. 10 "Governmental agency" includes all agencies, authorities, 11 boards, commissions, departments, institutions, offices, and 12 any other bodies politic and corporate of the State created by 13 the constitution or statute, whether in the executive, 14 judicial, or legislative branch; all units and corporate 15 outgrowths created by executive order of the Governor or any 16 constitutional officer, by the Supreme Court, or by resolution 17 of the General Assembly; or agencies, authorities, boards, 18 commissions, departments, institutions, offices, and any other 19 bodies politic and corporate of a unit of local government, or 20 school district. 21 "Home address" includes a public official's permanent 22 residence and any secondary residences affirmatively 23 identified by the public official, but does not include a HB5276 - 2 - LRB104 16852 BDA 30262 b 1 public official's work address. 2 "Immediate family" includes a public official's spouse, 3 child, or parent or any individual who is a blood relative of 4 the public official or the public official's spouse and who 5 lives in the same residence as the public official. 6 "Personal information" means a home address, home 7 telephone number, mobile telephone number, pager number, 8 personal email address, social security number, federal tax 9 identification number, checking and savings account numbers, 10 credit card numbers, marital status, and identity of children 11 under the age of 18. 12 "Public official" includes: 13 (1) members or former members of the Illinois General 14 Assembly; 15 (2) constitutional officers or former constitutional 16 officers; 17 (3) elected or appointed State's Attorneys; 18 (4) appointed Public Defenders; and 19 (5) county clerks and members of a Board of Election 20 Commissioners whose responsibilities include 21 administering and overseeing elections ; and 22 (6) law enforcement officers . 23 "Publicly available content" means any written, printed, 24 or electronic document or record that provides information or 25 that serves as a document or record that provides information 26 or that serves as a document or record maintained, controlled, HB5276 - 3 - LRB104 16852 BDA 30262 b 1 or in the possession of a governmental agency that may be 2 obtained by any person or entity, from the Internet, from the 3 governmental agency upon request either free of charge or for 4 a fee, or in response to a request under the Freedom of 5 Information Act. 6 "Publicly post" or "publicly display" means to communicate 7 to another or otherwise make available to the public. 8 "Written request" means written notice signed by a public 9 official or a representative of the public official's office 10 or the public official's employer requesting a governmental 11 agency, person, business, or association to refrain from 12 posting or displaying publicly available content that includes 13 the official's personal information. 14 (Source: P.A. 104-443, eff. 1-1-26.)
