SYNOPSIS AS INTRODUCED:

25 ILCS 170/10

from Ch. 63, par. 180

Amends the Lobbyist Registration Act. Provides that any person who is
convicted of any felony relating to, arising out of, or in connection with
any activity regulated by the Act is prohibited for a period of 5 years
from the date of such conviction from lobbying as a registered lobbyist
under the Act. Effective immediately.

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois,
3
represented in the General Assembly:

Section 5.
The Lobbyist Registration Act is amended by
5
changing Section 10 as follows:

Sec. 10.
Penalties.
8

(a) Any person who violates any of the provisions of this
9
Act, except for a violation of Section 4.7 or paragraph (d) of
10
Section 5, shall be guilty of a business offense and shall be
11
fined not more than $10,000 for each violation. Every day that
12
a report or registration is late shall constitute a separate
13
violation. In determining the appropriate fine for each
14
violation, the trier of fact shall consider the scope of the
15
entire lobbying project, the nature of activities conducted
16
during the time the person was in violation of this Act, and
17
whether or not the violation was intentional or unreasonable.

(a-5) A violation of Section 4.7 or paragraph (d) of
19
Section 5 shall be considered a violation of the State
20
Officials and Employees Ethics Act, subject to the
21
jurisdiction of the Executive Ethics Commission and to all
22
penalties under Section 50-5 of the State Officials and
23
Employees Ethics Act.

(b) In addition to the penalties provided for in
2
subsections (a) and (a-5) of this Section, any person
3
convicted of any violation of any provision of this Act is
4
prohibited for a period of
3

three
years from the date of such
5
conviction from lobbying
, except as provided in subsection
6
(b-5)
.

(b-5) Any person who is convicted of any felony relating
8
to, arising out of, or in connection with any activity
9
regulated by this Act is prohibited for a period of 5 years
10
from the date of such conviction from lobbying as a registered
11
lobbyist under this Act.
12

(c) There is created in the State treasury a special fund
13
to be known as the Lobbyist Registration Administration Fund.
14
All fines collected in the enforcement of this Section shall
15
be deposited into the Fund. These funds shall, subject to
16
appropriation, be used by the Office of the Secretary of State
17
for implementation and administration of this Act.
18

Effective date.
This Act takes effect upon

becoming law.
