SYNOPSIS AS INTRODUCED:

305 ILCS 5/5-65 new

Amends the Medical Assistance Article of the Illinois Public Aid
Code. Requires the Department of Healthcare and Family Services to
establish and implement within 12 months after the effective date of the
amendatory Act a 3-year medical nutrition therapy pilot program that
provides targeted populations, that otherwise meet the eligibility
requirements for medical assistance, with nutrition education and
counseling to prevent, delay, manage, treat, or rehabilitate a disease or
condition. Provides that under the pilot program, medical nutrition
therapy services shall be provided by a registered dietitian licensed
under the Dietitian Nutritionist Practice Act who is acting within the
scope of his or her license. Provides that program services shall include
nutrition assessment, nutrition intervention, nutrition counseling, and
nutrition monitoring and evaluation. Lists the populations targeted for
eligibility under the pilot program. Requires the Department to identify
and track the progress and health outcomes of program participants and
submit a report of its findings and recommendations on possible program
expansion to the Governor and the General Assembly within 3 months after
the pilot program terminates. Requires the Department to adopt any rules
necessary to implement the pilot program.

AN ACT concerning public aid.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Illinois Public Aid Code is amended by
5
adding Section 5-65 as follows:

Sec. 5-65.
Medical nutrition therapy pilot program.
The
8
Department shall establish and implement within 12 months
9
after the effective date of this amendatory Act of the 104th
10
General Assembly a 3-year medical nutrition therapy pilot
11
program that provides targeted populations, that otherwise
12
meet the eligibility requirements for medical assistance, with
13
nutrition education and counseling to prevent, delay, manage,
14
treat, or rehabilitate a disease or condition. Under the pilot
15
program, medical nutrition therapy services shall be provided
16
by a registered dietitian licensed under the Dietitian
17
Nutritionist Practice Act who is acting within the scope of
18
his or her license. Services shall include nutrition
19
assessment, nutrition intervention, nutrition counseling, and
20
nutrition monitoring and evaluation as defined in Section 10
21
of the Dietitian Nutritionist Practice Act. The following
22
targeted populations shall be eligible to participate in the
23
pilot program:

(1) persons receiving maternal and child health
2

services;

(2) recipients of health care services provided at
4

school-based clinics; and
5

(3) SNAP recipients who have been diagnosed with a
6

chronic health condition, including, but not limited to,
7

high blood pressure, heart disease, asthma, cancer,
8

diabetes, gestational diabetes, and any other medical
9

condition associated with high-risk pregnancy.

The Department shall identify and track the progress and
11
health outcomes of program participants and submit a report of
12
its findings and recommendations on possible program expansion
13
to the Governor and the General Assembly within 3 months after
14
the pilot program terminates. The Department shall not include
15
in its report any personally identifiable information of
16
persons participating in the pilot program.

The Department shall adopt any rules necessary to
18
implement the pilot program.
