SYNOPSIS AS INTRODUCED:
New Act
815 ILCS 505/2Z
from Ch. 121 1/2, par. 262Z
Creates the Vehicle History Report Requirements for Used or Pre-Owned
Vehicle Sales Act. Requires every licensed motor vehicle dealer in the
State to provide a current vehicle history report to each customer to whom
the licensed motor vehicle dealer sells a used or pre-owned vehicle.
Provides that before assuming ownership of a used or pre-owned vehicle,
the customer must sign a document confirming receipt and review of the
vehicle history report. Provides that any licensed motor vehicle dealer,
body shop, or other organization that inaccurately reports the mileage or
historical data of a used or pre-owned vehicle being bought, sold,
serviced, or inspected is in violation of the Act, for which the penalty is
a fine of $1,000 per violation and, for subsequent violations, suspension
or revocation of the business license or certification of the offending
organization. Provides that any collected fine shall be deposited into the
Illinois Dealer Recovery Trust Fund. Requires a licensed motor vehicle
dealer, body shop, or other organization that incurs a fine to report the
annual amount of fines incurred on the motor vehicle dealer's, body
shop's, or other organization's annual accounting report or audit.
Provides that a violation of the Act constitutes an unlawful business
practice. Makes a conforming change in the Consumer Fraud and Deceptive
Business Practices Act.

AN ACT concerning business.

Be it enacted by the People of the State of Illinois,
3
represented in the General Assembly:

Section 1.
Short title.
This Act may be cited as the
5
Vehicle History Report Requirements for Used or Pre-Owned
6
Vehicle Sales Act.
7
Section 5.
Purpose.
The purpose of this Act is to require
8
licensed motor vehicle dealers to provide vehicle history
9
reports for used or pre-owned vehicles sold in this State,
10
ensuring transparency and consumer protection.
11
Section 10.
Definitions.
As used in this Act:
12
"Used or pre-owned vehicle" means any motor vehicle that
13
has been previously titled or registered.
14
"Vehicle history report" means a comprehensive report
15
providing historical data about a motor vehicle, obtained from
16
a certified and qualified business that specializes in vehicle
17
history reporting.

Section 15.
Requirement to provide vehicle history
19
reports.

(a) Every licensed motor vehicle dealer in this State must
21
provide a current vehicle history report to each customer to

whom the licensed motor vehicle dealer sells a used or
2
pre-owned vehicle sold.

(b) The vehicle history report must be:
4
(1) specific to the vehicle identification number of
5
the vehicle being sold;
6
(2) printed on the day of the sale; and
7
(3) obtained from a certified and qualified business
8
specializing in vehicle history reports.
9
(c) The report shall include, without limitation:
10
(1) recall information for the vehicle;
11
(2) odometer readings for the vehicle;
12
(3) crash history, if any, for the vehicle; and
13
(4) any other pertinent historical data related to the
14
vehicle.

Section 20.
Customer acknowledgment.
16
(a) Before assuming ownership of a used or pre-owned
17
vehicle, the customer must sign a document confirming receipt
18
and review of the vehicle history report.
19
(b) The vehicle history report and acknowledgment document
20
must be provided in a language that the customer understands
21
and can read.

Section 25.
Penalties for inaccurate reporting.

(a) Any licensed motor vehicle dealer, body shop, or other
24
organization that inaccurately reports the mileage or other

pertinent historical data of a used or pre-owned vehicle being
2
bought, sold, serviced, or inspected is in violation of this
3
Act.
4
(b) Penalties for violations include:
5
(1) A fine of $1,000 per violation.
6
(2) For subsequent violations, suspension or
7
revocation of the business license or certification of the
8
offending organization.
9
Any fine collected under this subsection shall be
10
deposited into the Illinois Dealer Recovery Trust Fund. A
11
licensed motor vehicle dealer, body shop, or other
12
organization that incurs a fine under this subsection must
13
report the annual amount of fines incurred on the motor
14
vehicle dealer's, body shop's, or other organization's annual
15

(c) A violation of this Act constitutes an unlawful
17
business practice under the Consumer Fraud and Deceptive
18
Business Practices Act.

Section 35.
Applicability.
This Act applies exclusively to
20
used or pre-owned vehicles sold within this State.
21
Section 40.
The Consumer Fraud and Deceptive Business
22
Practices Act is amended by changing Section 2Z as follows:

Sec. 2Z.
Violations of other Acts.
Any person who
2
knowingly violates the Automotive Repair Act, the Automotive
3
Collision Repair Act, the Home Repair and Remodeling Act, the
4
Dance Studio Act, the Physical Fitness Services Act, the
5
Hearing Instrument Consumer Protection Act, the Illinois Union
6
Label Act, the Installment Sales Contract Act, the Job
7
Referral and Job Listing Services Consumer Protection Act, the
8
Travel Promotion Consumer Protection Act, the Credit Services
9
Organizations Act, the Automatic Telephone Dialers Act, the
10
Pay-Per-Call Services Consumer Protection Act, the Telephone
11
Solicitations Act, the Illinois Funeral or Burial Funds Act,
12
the Cemetery Oversight Act, the Cemetery Care Act, the Safe
13
and Hygienic Bed Act, the Illinois Pre-Need Cemetery Sales
14
Act, the High Risk Home Loan Act, the Payday Loan Reform Act,
15
the Predatory Loan Prevention Act, the Mortgage Rescue Fraud
16
Act, subsection (a) or (b) of Section 3-10 of the Cigarette Tax
17
Act, subsection (a) or (b) of Section 3-10 of the Cigarette Use
18
Tax Act, the Electronic Mail Act, the Internet Caller
19
Identification Act, paragraph (6) of subsection (k) of Section
20
6-305 of the Illinois Vehicle Code, Section 11-1431, 18d-115,
21
18d-120, 18d-125, 18d-135, 18d-150, or 18d-153 of the Illinois
22
Vehicle Code, Article 3 of the Residential Real Property
23
Disclosure Act, the Automatic Contract Renewal Act, the
24
Reverse Mortgage Act, Section 25 of the Youth Mental Health
25
Protection Act, the Personal Information Protection Act,
or
26
the Student Online Personal Protection Act
, or the Vehicle
