Paul Faraci SYNOPSIS AS INTRODUCED: 625 ILCS 5/3-421 from Ch. 95 1/2, par. 3-421 Amends the Illinois Vehicle Code. Provides that a person may reassign his or her registration plate to another person. Provides that, if a person who has a registration plate in his or her name seeks to reassign the registration plate to another person (rather than his or her spouse or child), the Secretary of State shall waive any transfer fee or vanity or personalized registration plate fee. LRB104 17007 LNS 30422 b A BILL FOR SB2858 LRB104 17007 LNS 30422 b 1 AN ACT concerning transportation. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Section 3-421 as follows: 6 (625 ILCS 5/3-421) (from Ch. 95 1/2, par. 3-421) 7 Sec. 3-421. Right of reassignment. 8 (a) Every natural person shall have the right of 9 reassignment of the license number issued to him during the 10 current registration plate or digital registration plate term, 11 for the ensuing registration plate or digital registration 12 plate term, provided his or her application for reassignment 13 is received in the Office of the Secretary of State on or 14 before September 30 of the final year of the registration 15 plate or digital registration plate term as to a vehicle 16 registered on a calendar year, and on or before March 31 as to 17 a vehicle registered on a fiscal year. The right of 18 reassignment shall apply to every natural person under the 19 staggered registration system provided the application for 20 reassignment is received in the Office of the Secretary of 21 State by the 1st day of the month immediately preceding the 22 applicant's month of expiration. 23 In addition, every natural person shall have the right of SB2858 - 2 - LRB104 17007 LNS 30422 b 1 reassignment of the license number issued to him for a 2 two-year registration, for the ensuing two-year period. Where 3 the two-year period is for two calendar years, the application 4 for reassignment must be received by the Secretary of State on 5 or before September 30th of the year preceding commencement of 6 the two-year period. Where the two-year period is for two 7 fiscal years commencing on July 1, the application for 8 reassignment must be received by the Secretary of State on or 9 before April 30th immediately preceding commencement of the 10 two-year period. 11 (b) Notwithstanding the above provision, the Secretary of 12 State shall, subject to the existing right of reassignment, 13 have the authority to designate new specific combinations of 14 numerical, alpha-numerical, and numerical-alpha licenses for 15 vehicles registered on a calendar year or on a fiscal year, 16 whether the license be issued for one or more years. The new 17 combinations so specified shall not be subject to the right of 18 reassignment, and no right of reassignment thereto may at any 19 future time be acquired. 20 (c) A person may reassign his or her registration plate to 21 another person. If a person has a registration plate in his or 22 her name and seeks to reassign the registration plate to 23 another person his or her spouse , the Secretary shall waive 24 any transfer fee or vanity or personalized registration plate 25 fee upon both persons spouses signing a form authorizing the 26 reassignment of registration.
