SYNOPSIS AS INTRODUCED:

30 ILCS 500/50-87 new

Amends the Illinois Procurement Code. Provides that each State
purchasing agency shall submit a procurement reform report to the Governor
and the General Assembly. Creates the Reforming State Procurement Task
Force. Sets forth the membership of the Task Force. Provides that the Task
Force shall conduct public hearings to review and take testimony on the
reports filed by the State purchasing agencies. Provides that the Task
Force shall submit certain reports. Effective immediately.

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois,
3
represented in the General Assembly:

Section 5.
The Illinois Procurement Code is amended by
5
adding Section 50-87 as follows:

6

(30 ILCS 500/50-87 new)
7

Sec. 50-87.
Procurement reports; Reforming State
8
Procurement Task Force.

9

(a) It is the intent of the General Assembly to address
10
concerns raised by State agencies during Senate Appropriations
11
Committee hearings about the current procurement process. It
12
is also the intent of the General Assembly to create a
13
procurement system that is effective, efficient, transparent,
14
and free of corruption and steering.
15

(b) On or before December 31, 2026, each State purchasing
16
agency shall submit a procurement reform report to the
17
Governor and the General Assembly that sets forth the
18
following:

19

(1) concerns about the current procurement process,
20

including specific, real issues and a list of the
21

problematic statutory provisions or rules; and

22

(2) recommendations for how the procurement process
23

can be reformed to be more efficient, effective,

transparent, and free of corruption; these recommendations
2

shall include specific legislative language to effectuate
3

the recommendation.

(c) There is hereby created the Reforming State
5
Procurement Task Force. The Task Force shall conduct public
6
hearings to review and take testimony on the reports filed by
7
the State purchasing agencies under subsection (b). The Task
8
Force shall consist of the following appointees who shall be
9
appointed by January 15, 2027:

10

(1) the Chief Procurement Officer for the Capital
11

Development Board;

12

(2) the Chief Procurement Officer for the Department
13

of Transportation;

14

(3) the Chief Procurement Officer for General
15

Services;

16

(4) the Chief Procurement Officer for Higher
17

Education;

18

(5) the Director of Central Management Services or his
19

or her designee;

20

(6) the Secretary of Transportation or his or her
21

designee;

22

(7) the chairperson of the Capital Development Board
23

or his or her designee;

24

(8) 2 employees of a State agency who deal with
25

procurement, appointed by the Governor; these appointees
26

shall not be from the same agency;

(9) 2 Illinois vendors and one member of the House of
2

Representatives, all appointed by the Speaker of the House
3

of Representatives;

4

(10) 2 Illinois vendors and one member of the House of
5

Representatives, all appointed by the Minority Leader of
6

the House of Representatives;

7

(11) 2 Illinois vendors and one Senator, all appointed
8

by the President of the Senate;

9

(12) 2 Illinois vendors and one Senator, all appointed
10

by the Minority Leader of the Senate.

(d) The Task Force shall conduct its first hearing by
12
February 1, 2027 and must conduct at least 4 additional
13
hearings before April 15, 2027.

14

(e) The Task Force shall submit a report to the Governor
15
and the General Assembly by May 1, 2027 that outlines
16
recommendations and legislative language for legislative
17
changes to the State procurement process.

18

(f) This Section is repealed on January 1, 2028.

19

Section 99.
Effective date.
This Act takes effect upon
20
becoming law.
