SYNOPSIS AS INTRODUCED:
65 ILCS 5/11-80-13

65 ILCS 5/11-80-26 new
Amends the Illinois Municipal Code. Provides that the corporate
authorities of a that the corporate authorities of a municipality may
require the owner or occupant of any premises to keep the sidewalks
abutting the premises maintained in reasonable condition, including
keeping the sidewalk free from snow and other obstructions and making
repairs as needed (rather than keep the sidewalks abutting the premises
free from snow and other obstructions). Provides that the corporate
authorities of a municipality may regulate the use and maintenance of
parkways and may require the owner, lessee, and occupant of any property
abutting a parkway to be responsible for maintenance of the parkway,
including, but not limited to, cleanup and disposal of refuse, waste, and
garbage in the parkway; watering and fertilizing plants, trees, and
grasses in the parkway; and the routine care of the lawn of the parkway,
including, but not limited to, watering, weeding, and mowing of the lawn of
the parkway.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Illinois Municipal Code is amended by
5
changing Section 11-80-13 and by adding Section 11-80-26 as
6
follows:

Sec. 11-80-13.
The corporate authorities of each
9
municipality may regulate the use of sidewalks, the
10
construction, repair, and use of openings in sidewalks, and
11
all vaults and structures thereon and thereunder, including
12
telephone booths, and may require the owner or occupant of any
13
premises to keep the sidewalks abutting the premises
14
maintained in reasonable condition, including keeping the
15
sidewalk
free from snow and other obstructions
and making
16
repairs as needed
.

Parkways.

(a) As used in this Section, "parkway" means the portion
21
of a public right-of-way between the curb of a street and the
22
property line of private or public property, where a sidewalk

is often located.

(b) The corporate authorities of a municipality may
3
regulate the use and maintenance of a parkway and may require
4
the owner, lessee, and occupant of a property that abuts a
5
parkway to be responsible for maintenance of the parkway,

including, but not limited to, cleanup and disposal of refuse,
7
waste, and garbage in the parkway; watering and fertilizing
8
