SYNOPSIS AS INTRODUCED:

55 ILCS 5/5-1195 new
65 ILCS 5/11-30-11 new

Amends the Counties Code and the Illinois Municipal Code. Provides
that a county or municipality may not adopt any regulation that prohibits
or has the effect of prohibiting the use of natural gas in new construction
without a referendum. Limits the concurrent exercise of home rule powers.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Counties Code is amended by adding Section
5
5-1195 as follows:

(55 ILCS 5/5-1195 new)
7

Sec. 5-1195.
Prohibiting the use of natural gas in new
8
construction.
Notwithstanding any other provision of law, a
9
county may not adopt any regulation that prohibits or has the
10
effect of prohibiting the use of natural gas in new
11
construction without a referendum. A home rule county may not
12
regulate natural gas in a manner inconsistent with this
13
Section. This Section is a limitation under subsection (i) of
14
Section 6 of Article VII of the Illinois Constitution on the
15
concurrent exercise by home rule units of powers and functions
16
exercised by the State.

Section 10.
The Illinois Municipal Code is amended by

adding Section 11-30-11 as follows:

(i) of Section 6 of Article VII of the Illinois Constitution on

the concurrent exercise by home rule units of powers and
8
functions exercised by the State.
