SYNOPSIS AS INTRODUCED:

305 ILCS 5/12-4.60 new

Amends the Administration Article of the Illinois Public Aid Code.
Provides that the Department of Human Services and the Department of
Healthcare and Family Services, whichever is applicable, shall not
consider veterans' disability benefits as countable income when
determining an individual's eligibility for medical assistance, child care
assistance, and Supplemental Nutrition Assistance Program benefits.
Requires the Departments to apply for any federal waivers or approvals
necessary to implement this income exemption.

AN ACT concerning public aid.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Illinois Public Aid Code is amended by
5
adding Section 12-4.60 as follows:

(305 ILCS 5/12-4.60 new)

Sec. 12-4.60.
Veterans' disability benefits exemption;
8
medical assistance, child care, and SNAP.
Subject to federal
9
approval, if required, the Department of Human Services and
10
the Department of Healthcare and Family Services, whichever is
11
applicable, shall not consider veterans' disability benefits
12
as countable income when determining an individual's
13
eligibility for medical assistance under Article V, child care
14
assistance under Article IXA, and benefits provided under the
15
Supplemental Nutrition Assistance Program. The Departments
16
shall apply for any federal waivers or approvals necessary to
17
implement this income exemption.
