Terri Bryant SYNOPSIS AS INTRODUCED: 40 ILCS 5/3-144.3 new 40 ILCS 5/4-138.15 new 30 ILCS 805/8.50 new Amends the Illinois Pension Code. Provides that the Retirement Systems Reciprocal Act (Article 20 of the Code) is adopted and made a part of the Downstate Firefighter and Downstate Police Articles, but only with respect to a person who, on or after the effective date of the amendatory Act, is entitled under the Downstate Firefighter Article or Downstate Police Article to begin receiving a retirement annuity or survivor's annuity and who elects to proceed under the Retirement Systems Reciprocal Act. Amends the State Mandates Act to require implementation without reimbursement by the State. The Illinois Pension Code is amended by adding 5 Sections 3-144.3 and 4-138.15 as follows: 6 (40 ILCS 5/3-144.3 new) 7 Sec. 3-144.3. Retirement Systems Reciprocal Act. The 8 Retirement Systems Reciprocal Act, Article 20 of this Code, is 9 adopted and made a part of this Article, but only with respect 10 to a person who, on or after the effective date of this 11 amendatory Act of the 104th General Assembly, is entitled 12 under this Article to begin receiving a retirement annuity or 13 survivor's annuity (as those terms are defined in Article 20) 14 and who elects to proceed under the Retirement Systems 15 Reciprocal Act. 16 (40 ILCS 5/4-138.15 new) 17 Sec. 4-138.15. Retirement Systems Reciprocal Act. The 18 Retirement Systems Reciprocal Act, Article 20 of this Code, is 19 adopted and made a part of this Article, but only with respect 20 to a person who, on or after the effective date of this 21 amendatory Act of the 104th General Assembly, is entitled 22 under this Article to begin receiving a retirement annuity or SB3199 - 2 - LRB104 18997 RPS 32442 b 1 survivor's annuity (as those terms are defined in Article 20) 2 and who elects to proceed under the Retirement Systems 3 Reciprocal Act. 4 Section 90. Notwithstanding Sections 6 and 8 8 of this Act, no reimbursement by the State is required for 9 the implementation of any mandate created by this amendatory 10 Act of the 104th General Assembly.
